Hum
It may make a difference that it is 'Windows Vista', not merely Vista. And I'm sure there will be Microsoft payola, in need be -- not a name change.

Axel
Yeah but Microsoft are abit dumb... don't they check out the name Vista before making it there OS? 586538449 They're not dumb. They're simply a huge corporation and can get away with pretty much what they want! Any lawsuit could probably come under the "branding budget" or something along those lines ;)
AQUaDeX
Their product name is Windows Vista, if they trademark it it will be Windows Vista, Microsoft don't care about wheather the word "Vista" has been trademarked or not as it's a common word. SMELTN
agreed. Its Windows Vista not just Vista.. Clearly legal.. if not oh well I am Microsoft I will MAKE it legal.. hehe

Like linux for example. Linux has become so overly used for many many different types that it can no longer be trademarked. It is not recognizeable as a brand name anymore because many many different organizations run linux. If torvalds would have trademarked it earlier maybe this would be a different story. As for Windows Vista in this case. I doubt they will have any problems. The word vista is so overused that no single company or organizations can hold it as their own. Besides, Microsoft are Trademarking it as 'Windows Vista' not just vista. Game over, no problems. Further more, spelling Microsoft with a $ does not make you cool. Just recently Tolvards began a "campaign" to defend the trademark so it didn't get invalidated.
Scorbing
Excuse me but their name is not Windows Vista so it will have no effect on Microsoft as far as the law is concerned. Windows Vista is one name, Bricscad Vista is another. Two different names. If they sue Microsoft for the name Vista then they will have to sue this people as well: http://genome.lbl.gov/vista/index.shtml http://www.vista.ac.uk/ http://forrest.psych.unc.edu/research/ http://www.cs.ubc.ca/nest/lci/vista/vista.html http://www.garmin.com/products/etrexVista/ http://vista.com/ http://www.vistamagazine.com/ http://www.vistapro.com/ http://www.visualstats.org/ http://www.vistaimaging.com/ http://www.vista.ru/ Should I go on? As long as Windows Vista is not trademarked by someone else, MS doesn't care.

Slimy
It may make a difference that it is 'Windows Vista', not merely Vista. 586538436 exactly and this isn't news. but either way, ms will have to deal with lawsuits, even if they called it Windows GAsjdflkajsdf. Chadwick
its amazing how this is identical to the case with the iPod Nano, yet everyone goes "i hope apple gets sued, i hope they get their asses handed to them etc. etc." but when its microsoft, everyone stands up for them. Its unbelievable that in between the intillegent groups that actually know whats going on who can respect both companys there are so many people that totally ruin topics with lack of knowledge. A nice example of this whole name issue is Acme, Acme Markets is a huge foodchain owned by Albertsons, but look at how many companys have Acme in their name ;) When was the last time you heard about a company with Acme in the name getting sued? exactly. Once again, companys like microsoft, apple, etc. have people paid 5-6 figures to research this stuff in every country you can imagine to make sure they can sell their product there with that name without getting slapped with a lawsuit. Slimy
uh, how is this similar to the apple case? an mp3 player name vs an mp3 player name is not the same as an supplier of intellicad vs an os.
megamanXplosion
"VISTA" and "Windows Vista" are not the same. Bricscad does not have a trademark on "Windows Vista" so this entire topic is pointless.
JK1150
You can't TM a word, Windows Vista is not trademarked, that is the product name. the product name is not "Vista." I'm surprised you found this, but didn't find that Vista is an organization: Volunteers In Service To America. Again, you can't trademark a word. Yet again, this companys know what they are doing.
Nashy
I like how so many people thrive on thinking that Microsoft made a big booboo. Seriously people, if you think Microsoft doesn't research these things, and have hundreds of law professionals checking things out for them, then you are stupid. Microsoft knows what they are doing.
