I downloaded this theme, but I couldn't find any hint that you got hermik's permission...
You need permission before you release it...

Why didn't you mention it in your Readme. This is the frist place where I'd expect something like a permission.

A Readme file is not permited on theme package, only winrar_theme_description.txt who is present. See http://www.rarlab.com/themes_new.txt
