Apple forced to remove 3G iPads, iPhone 3GS and iPhone 4 from German online store

Apple has been forced to remove 3G iPad, iPhone 3GS, and iPhone 4 from its online German store today following a dispute with Motorola Mobility. FOSS Patents reports that the decision is likely due to a ruling from December, and not related to an iCloud injunction issued today. Apple appears to have posted a 100 million euro bond to enforce the ruling.

All models are still available in German retail Apple stores and authorized dealers, and Apple rejects the injunction on the grounds that Motorola refused to license the patent at issue on acceptable terms.

Well this might actually come back to burn Motorola since they have to, by law, license it via FRAND standards. Apple could very easily counter sue for loss of profits.

Why does that matter? If they would file an appeal and win, they could definitely counter sue.

Except that has nothing to do with what Astra.Xtreme said. Motorola sued Apple for violating Motorola's patents. While Motorola could be right, if it turns out that they never gave Apple a fair chance to license it (FRAND) they could be in trouble and end up paying Apple in damages.

And yes, in previous court hearings it was shown that Motorola did offer fair licensing terms more then once and Apple just didn't want to pay.

Apple says it's still lobbying for a reversal, and that the pulled devices are still available at brick-and-mortar retailers within Germany.

In other words, they are trying to bribe everyone and their mothers with cash now to try to overturn the ruling. Good luck Apple douchebags. And that availability at retailers won't be for much longer.

motorola did provide a fair license deal but apple didnt accept.

this is good news.... Apple should learn a lesson first....

Funny how apple cries and bitches when things are unreasonable towards them...but they can turn around and do things to others that are unreasonable and its ok.

An appeals court lifted the ban after Apple made a new licence payment offer. However, Germany-based users may still face the loss of their push email iCloud service after a separate ruling. Patent consultant Florian Mueller, who attended the review, said that the suspension may only last a few days or weeks - but that Apple's revised proposal had been enough to allow it to restart sales. "The Karlsruhe higher regional court believes that Apple's new offer needs to be evaluated before this injunction can enter into force again,"he wrote on his blog. "A suspension like this is available only against a bond, but Apple is almost drowning in cash and obviously won't have had a problem with obtaining and posting a bond." He said that the bond amount was likely to have been about 120m euros ($158m, ?100m).

Did you even read the article? Patent infringement and a REQUIRED licensing (FRAND) are two very different things.

Not really. Apple complained that this was unreasonable because it was. The court saw it too, so case closed and Apple was right.

Apple complained that Samsung stole their designs and they won in Germany, so yet again, they were right.

They are winning plenty of these cases, so why exactly are they being unreasonable? They are the victim...

They are losing more of the cases than they are winning. They won first in Germany but not with the 10.1n model. Samsung can sell this model even after Apple appealed the decision...Samsung still won. Samsung has also won several other cases as well. Like in Australia.

And unreasonable meaning sending Samsung design tips. In a nutshell, Apple wants Samsung to redesign its products to Apple's liking and have Samsung products to be big, bulky, thick, and an eye sore to look at.

Suing over packaging, flat glass surface...are also stupid and unreasonable. A lot of other phones/tabs have a flat glass look, black borders, and are thin but they are not being sued. Why? Because as of yet, they are not a threat to Apple as Samsung is.

Every other company has a right to protect their patented property, so why do you complain a storm when Apple does? That's how the system works, and welcome to the business world...

Not just my opinion. A lot of other people's opinion as well (do a search, read comments) and apparently, the courts are starting to think so as well with allowing Samsung to sell its products. So thanks but no thanks for "fixing" my comment.

And yes, everyone has a right to protect their patent property but with all tablets having a lot of similar designs that Apple is bitching about Samsung, Samsung is the only one getting sued for it.

Again, it's just your opinion. If they were to lose every single case, then yes Apple would be completely wrong in every way. But these are going both ways, so it's all just opinions.

Like I said, welcome to business. Apple could take every little company to court and file the same suits, but the overall gain would be little to none in those cases even if they won. Samsung is a huge company, and if they can prove their case against them, it sends a message to everybody else for free. If you beat the guy at the top, you automatically become champion, so why would you pick fights with the weaklings?

If I was the only one thinking and saying these things, then yes...it would me my opinion. But a lot of others are thinking the same way as well as the courts. Dont need to win every case to be wrong and I never said Apple was wrong in every way. Just said some of what they are bitching about is silly and stupid.

And a lot of people agree that Apple is the one getting screwed over. What's your point?

It's not "bitching" when they have a valid patent and a valid ground of somebody infringing it. If somebody stole something you designed and was profiting off of it, you'd be angry as well.
