Apple Sues Kodak, Takes Advantage of Film Giant's Poor Position

Apple asked a bankruptcy judge if it could file a patent infringement lawsuit against Kodak yesterday

As if repeatedly attacking Samsung, HTC and Motorola Mobility with patent infringement lawsuits wasn't enough, Apple is now looking to kick Kodak while it's down with digital camera, printer and digital picture frame-related infringement suits as well.

Apple's Valentine's Day present to Kodak was a filing in the U.S. Bankruptcy Court in New York yesterday, where Apple said it is filing patent infringement claims against Kodak with the International Trade Commission (ITC) as well as the U.S. District Court in Manhattan. Apple asked a bankruptcy judge for permission to sue Kodak first, despite the fact that filing for bankruptcy doesn't protect Kodak from infringement suits.

Apple had claimed before that it created a digital camera in the 1990's along with Kodak, but Kodak supposedly moved ahead with patenting the camera on its own. Apple had filed the case with the U.S. International Trade Commission in Washington, where the ITC rejected Apple's claims. Yesterday, Apple said in the filing that it wanted to move the case to Manhattan.

"Apple should not be using the bankruptcy to seek to disrupt Kodak's enforcement of its patents given that infringers like Apple, who continue to violate Kodak's intellectual property rights and refuse to properly compensate it, have contributed to Kodak's current circumstances," said Kodak.

It's really like Apple just hired a brand-new, fresh-faced lawyer, who's determined to prove himself to the big boys. That's honestly what this sounds like. They are such a joke these days.

Keep in mind that your full of ****. Apple nowhere said that they invented the digital camera. "Apple claims that through its partnership with Kodak to produce QuickTake digital cameras during the mid-1990s, Kodak misappropriated intellectual property involved in the project and patented it for itself."

This is a patent war. Kodak is suing Apple and Apple is suing back. It's not Apple's fault the patent system is screwed up, its yours. You elect the officials that are put into office. And when they are elected and don't fix the problem, don't go crying that someone is taking advantage of it.

Anyway, I see this getting tossed out. Why would Apple wait 20 years to sue Kodak if this was that important to them. Just sounds like Apple is tossing its weight around...again.

They are doing this because Kodak is going to go bankrupt. They are going to be sold or are going to be closed down and their patents auctioned off. Apple can save some money by getting some of the patents back right now, that may or may not be rightfully theirs, before this happens.

Also, THEY HAVE NOT SUED YET.

While Apple says in its filing with the bankruptcy court overseeing Kodak's case that it is not required to seek approval for a lawsuit, Apple notes that it is requesting the court's blessing "out of an abundance of caution".

And yes, they have not sued....yet.

Maybe because Kodak was the Apple of today back then? Maybe because Apple didn't have much lobbying power until now? Who knows. What we do know is that Kodak is suing Apple, Apple is going to sue Kodak, and Apple probably will win because of the sh*ty system we have in place.

No one is safe anymore. Everyone and everything is a target to be sued. It's the world we live in, unfortunately. :/

That's because they infringed on Kodak's patents with the iPhone and when they started building hardware with digital imaging. That's why they got sued. Apple just like with anything else, feels entitled to use whatever they want from other people in their products without paying for it. From patents to music in their videos to pretty much everything.

Apple is doing this now for several reasons really. You sue a company that's going bankrupt so you can blackmail them as Kodak can't afford to fight a legal battle. What they probably want is their patents to try to get another thing to sue Android manufacturers and others and to bury Kodak as a company. It's not really hard to figure out what's going on.

Hoping someday soon the patent system will get an overhaul and rules changed. This is all beyond stupid no matter what company is involved.

The iPhone has been out since 2007, it's getting a bit late to sue now... oh yea but Kodak needs money right now so let's find people that we could sue :/

Easy, because Kodak is going bankrupt, Apple smells that it can potentially get some free or very cheap patents that it can then use to sue other companies.
