NAPLES, Fla., April 22 (UPI) -- After leaving a Naples, Fla., McDonald's without paying for a cup of soda, Mark Abaire, 52, is in hot water, facing a felony theft charge, police say.

Abaire walked into the restaurant around 10 p.m. Thursday and asked the employee at the counter if he could have a cup for water. When he was given one, he went to the soda fountain and filled it with soda instead, then left to sit outside. A manager told police he asked Abaire to pay for the soda and he refused, and then remained on the premises after being asked to leave. He then cursed at the manager, prompting them to call the police.

Due to previous petty theft convictions, what would have been a misdemeanor petty theft charge was escalated to a felony, which could earn Abaire up to five years in jail and a $5,000 fine. He also faces charges of trespassing and disorderly intoxication, the Daily News (Naples, Fla.) reported.

Sounds like he deserves it, no sympathy. If you don't learn from your past punishments it's your own fault.

What's the issue? As mentioned, he has priors.

I see no issue here.

That wouldn't have been a felony if:
1.) He would have paid for it when asked by police.
OR
2.) He would have left the McDonalds when asked by police
OR
3.) Would have been unruly.

He had his chances to walk away from that with nothing

Forget about soda. In prison, all the food is free.

Now he gets all the free soda/food/healthcare he could want.

Seriously though, he deserves what he gets. He apparently never learned his lesson.

********s like this who feel they can do what they want really annoy me.

They feel they can do whatever they want, not conform to society rules, legal rules, etc.

He's basically chosen to opt-out of society as a norm. Well fine, lock him up.

Yup - while in he won't have an opportunity to escalate to something worse. Hopefully he'll get a long probation too.
