Judge stops U.S. sales of Samsung Galaxy Tab 10.1

(Mashable) -- U.S. District Judge Lucy Koh has approved Apple's request for a preliminary injunction in the U.S. against Samsung's Galaxy Tab 10.1.

"Although Samsung has a right to compete, it does not have a right to compete unfairly, by flooding the market with infringing products," Koh wrote on Tuesday.

Apple filed a motion for a preliminary injunction in May 2012, claiming Samsung's Galaxy Tab 10.1 infringes on an iPad-related patent. Apple has also filed a similar motion against Samsung's Galaxy S III in June.

The judge's order becomes effective after Apple posts a $2.6 million bond as protection against damages suffered by Samsung if the injunction is later overturned

It's important to note, however, that this ruling only affects Samsung's older 10-inch tablet, the Galaxy Tab 10.1. It does not affect the updated Tab 10.1 II, which was unveiled in May 2012.

According to an IDC report from March 2012, Apple's iPad had a 54.7% market share in Q4 2011 while Samsung, which sells several tablet models, had a 5.8% share in the same period.

Samsung, which has already appealed (PDF link) the decision, said it doesn't expect this ruling to have a big impact on its business.

Can someone clarify if the "infringing material" is Samsung software laid over Android or if it is Android itself that Apple has taken issue with? I honestly can't remember where this originated.

The "infringing idea" is that Samsung dared to copy Apple's bold and impressive design idea of making a rectangular shaped tablet.

I still can't believe they are still blocking over this.

Yet if you clearly look-- round corners - black with grey accents and approximation of the same size , but many years before .

When this is presented in court Apple gets it to be dismissed as not a valid example of Samsung using the design prior....

Please view the photo and be the judge yourself ....

They get it dismissed because it is a digital picture frame with sound.

The reason Apple wants Samsung and all other Android tablets out of the picture is simple:

They do not want to lower the price of the iPad. Competition will eventually force them to lower their prices down as Android tablets keep getting better and better and offering more for less and if this continues, Apple is gonna have no choice but to lower prices down or lose the battle to Android.

Congrats Apple on banning the 1st gen Samsung 10.1 tab. A tablet that will not be sold for very much longer (if at all currently). Version 10.1 Gen 2 looks even more different than the iPad. Not to mention, Samsung has the N model as well.

So again, congrats on getting out data hardware banned.

He is, maybe the new nexus google tablet will be a nice alternative to iPad. Iv used this Galaxy Tab and its pretty bad, touch sensitivity sucks as hell, the SO, the apps :( try to compare with an iPad 1 with some years of existence :) and you will see. GO to a shop and compare by hand, both.

There are also a lot of other patents that Oracle owns as far as using data into forms such as

Personnel database insertion of data tables from email sources or text files. (which is gathering names- phone numbers- from emails or text)

I have nothing against Apple, however , they should watch not to wake sleeping giants.

Which just goes to show how broke the Patent system is ... they rely on corporations to fight one another in court to figure out who had it first.

Thankfully patents are more detailed than just a title, so silly things like the one you are proposing don't happen. When there is a patent dispute, they dispute because everything down to implementation details was copied.

Sorry, This was not just the tittle- That was inside the Abstract for the patent

Which later on in that same patent it reads-

The use of user input or accumulated data from text ,emails, and attachments based upon strings to reference phone, email, names and addresses for use in automation of forms, databases, or programs that would use said data.

Which is part of the dispute that Apple has placed upon Samsung.

The phone being able to read phone numbers from messages to make phone calls. (which is using data obtained from email or text to add it to the contact list or to dial it as a phone number)

That is why I brought that specific patent up which could be argued in that case of the phone.

It would seem as if Apple has copied exactly in their patent except they reference a cell phone instead of a system.

And thus the conclusion that the Patent System is broke...

I also do understand why Apple thinks they have a case, however, it should be Oracle that is suing both Apple and Samsung.

I am no Apple fan, does Samsung manufacture anything in the world that is not a stolen design/product? ?

When I first saw the Galaxy I thought it was a iPhone.

Then you sir need your eyes tested.
