A 54-year-old Gainesville man distracted guard dogs with food before breaking into a fenced Holly Hill tow yard to retrieve his van, then rammed through the gates, police said.

The suspect didn't get far.

William Sherman Evans III broke down on U.S. 92 and got caught when an officer from the Florida Fish and Wildlife Commission stopped to check on him, an arrest report shows.

According to the Holly Hill police report, Evans' 1994 Dodge Ram van was towed by Arrow Wrecker and stored in the tow yard at 600 Carswell Ave. in Holly Hill.

Shortly after the breakout at 9 a.m. Sunday, Evans and the missing van were seen on the shoulder of U.S. 92 Monday. An FWC officer stopped to conduct a well-being check. It was then discovered that the van was reported stolen from Holly Hill.

"He was the rightful owner. He just went about the wrong way getting it back," said Holly Hill police Capt. Steve Aldrich.

At the Holly Hill police station, Evans admitted jumping the fence to get into the compound and said he distracted the dogs in the yard by feeding them chicken.

Evans caused more than $1,000 in damage when he rammed through the gate. His tow bill was $419.30, police said. He was charged with unarmed burglary of an occupied structure, criminal mischief and damage to property of $1,000 or more and grand theft. He was being held today at the Volusia County Branch Jail on $4,500 bail.

A 12 gauge is more reliable - pull most of the pellets out of the shells and sub in rock salt. Hurts like blue blases & takes hours to dig them out :)

I can see all the charges but grand theft? I do not believe you can steal your own car.

Wouldnt the car be the property of the state or whoever until the original fee was paid?

Bad DocM :) Then you add animal cruelty to the list of charges and the vet bills as well.
Plus the charge of unarmed burglary becomes armed burglary with the associated mandatory jail time.

I think he meant a 12 gauge is more reliable than a dog.

That was what i thought but turnabout is fair play and dogs are cheaper as you would probably need more staff to cover the same area.

I think the grand theft is possibly because the car was impounded so was technically the property of the state? Im taking a mega guess but thats how I see it.

Someone clarify?

Stealing your own car?? more like they stole his car and he was just retrieving his property. These sorts of places are absolute slime. Do not trust them or Tow truck drivers who will try to talk you into letting them take it there. Always a "mate who will look after you" for the repair, then they will gauge you in the repair bill if you so no, and hold your car hostage with storage fees as they know that the car can't go anywhere. If you can get the car driveable they will spew bull**** about how illegal it would be to drive it unless you get them to repair it (even when it is not true). I've had experience with a few of these places.

If the car was towed etc. then taking it without paying the fines/fees is stealing it. Also; grand theft is usually determined by the value of the item stolen or if it's in a certain class of items, and this varies by state. Values range as low as $250, and the clases of items usually include (minimum) automobiles and firearms.

Grand theft is even less in VA. I took a security course and had to learn this stuff. Anything over 200$ can be considered Grand Theft. Yes two hundred dollars is a felony.

$200 is madness!! That is so low for Grand theft
