Apple uses Nokia Lumia in court against Samsung

Probably one of the most entertaining moments came from Apple’s lawyers who were presenting their final case to the jury. At around 1:38 PM PT their lawyer, Harold McElhinny, evidently held up a unspecified Nokia Lumia Windows Phone and exclaimed...

"Not every smartphone needs to look like an iPhone."

In addition, some other device called the Sony Xperia Arc was shown too.

If there is one thing that can be said about the Windows Phone OS and the Nokia line of Lumias is that they certainly don’t copy from any of their competitors and instead have gone their own path.

And although Apple here had ulterior motives for demonstrating that smartphone companies can ‘think different’ when it comes to their products, we can’t think of a better example—or accidental endorsement—than Apple’s for-the-record testimony today in court.

And the only difference between Nokia and Samsung phones is that Nokia Lumia doesn't have rounded corners. So if it comes down to nobody else being allowed to make minimalistic design with rounded corners then the whole system went to sh** when one company can patent that.

Let's face it, the Samsung closing was dead on. The point here is not only that if Apple wins it is hoping to get absurd amount of money based on common sense things, but that they will without a doubt try to kill innovation and everyone anyone making minimalistic phones with even remote similarities to iPhone. This is simply unacceptable and I really hope jury will see this clearly.

could have sworn it had something to do with the colorful face plate, and big large almost full screen buttons of the new WinMo OS

and the whole system went to sh** a while ago, you know people hold patents on living things ?

If you actually read the transcript of that trial and the show judge created you would have seen that it was absolutely unfair. She covered the most distinguishable parts (including the back) and it was away from the lawyer. The lawyer said that the comparison is not fair because he can't see.

You can clearly see that Nokia is identical design of iPod. The only difference is that iPod didn't have a full screen but a wheel. The overall design is the point and they are very similar. It is clear that Nokia was inspired by it.

If iPod nano had a full touch screen surface you wouldn't be able to distinguish the difference between them.

Can you elaborate how the design is identical? I can see there are similarities, but the Lumia 800 really is a more refined Nokia N8.

It's funny how they think the Lumia is Identical to the old iPod, but can see no evidence that Samsung phones look at all like the iPhone..

Just a little selective vision there eh :p

The only thing they have in common is the fact that the Lumia comes in a range of colors.... that's it.

I am just amazed the trial has even gone this far. With some many other products looking similar in other industries, this is really stupid to fight about. Hopefully this trial will be a wake up call to start making some changes with the system. Sure glad there isnt this problem with PCs, TVs, cars, lan phones, monitors, mice, keyboards.....along with many other products, all have competitors that look similar. Any company complaining about another copy are hypocrites. They all do it.

Hopefully the jury is fare on both sides but have a feeling one or the other will be screwed. All I know is, consumers will be screwed in the end. And if Samsung gets screwed, who cares really. Many other Android devices to choose from that are just as good. Especially if the rumors are true about the next nexus devices being made by Samsung, Sony, and LG.

Actually there have been these cases with cars, and other products..

No one cared to report about them though because Apple wasn't involved..
