A World War II vet says he was tied up and shot twice during an attempted burglary earlier this year inside his California home. The accused criminal sees things differently, though, and now wants to file charges of his own.

Samuel Joseph Cutrufelli, 31, is on trial for attempted murder after allegedly shooting 90-year-old Jay Leone in the jaw and the back during a home robbery-gone-wrong back in January. When Cutrufelli attempted to flee Mr. Leone

You would have thought that he had learned the first time not to mess with that old man.

I feel sorry for the victim Mr. Leone, he lives in Cali, there's a good chance the criminal will win and have all charges dropped

In any other State where reason and logic rule, Mr. Leone would have an open and shut case

Good ole Califlakey - one of the now few states where this is still allowed. The vast majority of states have Castle Doctrine laws which provide a self-defender with criminal and civil immunity in situations like this.

:argh: As someone that was born and raised in the "wonderful" state of California, I can assure you this has jack squat to do with Obama. None, whatsoever. Please stop blaming him for crap that has NOTHING to do with him. California is the most liberal state in the country, and they also have some of the dumbest civilian laws I have ever seen. The fact that the deathly challenged robber is even able to sue Mr. Leone is about as screwed up as it gets after trying to kill him not once, but twice. This is an excellent example of why it's implied that when you "neutralize" the threat, you make sure it's "neutralized."

The only victim here is the homeowner. He should not even need a lawyer: The judge, jury, court (whoever) should all realise that this homeowner did nothing wrong, and that the only criminal is the disgusting robber.
