Well the pic is illegal XD just downloading it in the cache of your computer without watching it will cost you 50 years of your life.
AFAIK there is a Distinction between accidental exposure and wanting to see it (Shane Nokes).
Otherwise, sites like 4chan would be long gone.
Alas, when it comes to sex related crimes, it is guilty until proven innocent.

You realise i was joking right ? that's why i said 50 years to make the sarcasm clear ...

While i consider child porn as one of the worst possible crime i think these days people are streching it a lot. I swear one day it'll become illegal to own Nevermind album by Niravana ;)

Honestly i don't see why the mother should go to jail unless they can prove her intend was really to share it with people who are into that sexually speaking. I mean there's a photo of me nude when i was young in the family photo album and i like to think it's not the end of the world if by mistake i or someone of my family happen to share it online.

I didn't read the whole story, so I'm not sure how old the girl is, but as someone stated above, there is a bit to much "stretching it out" in these cases.
I remember a case earlier this year about video being uploaded to YouTube of a young girl having sex, and it being called "child pornography" and I got in a big argument with a friend. I wasn't saying it was right, but tried to explain to hi that for a very long time now, teens do have a lot of sex, and today everyone having cellphones and capturing video of everything at parties, etc. etc., to me isn't child pornography. (Under aged people doing porn in the porn industry is different)
Has everyone here waited till they were of legal age to have sex? I doubt it.
Also, like someone mentioned, the picture could have been uploaded automaticly, or the mom could have done it out of spite, as in to embarrass the daughter to teach her a lesson (which I'm not saying is right either).

actually, there has been a case where someone in the USA was prosecuted for having that naked baby album cover... and I'm not kidding... and the only way the case worked was because they put the cover off the album and framed it... therefore it was now a willingly created depiction... talk about stretching the law to get someone

so charge the girl with creation of child porn also, it's only fair right?
If she's underage, she can't be, afaik. Not under our laws here anyway.

seeing this happened in the USA, yes she can be, as US laws actually encourage District Attorneys to go after the kids (now days they call it "helping them", yeah help them ruin their lives forever)

I tink in some parts of the US if you're a teen, take pics of yourself and share them you can be charged with the creation of child porn and even be registered for life as a sex offender.

Hell, some people get caught taking a **** in public and can get put onto those registries.
