What I don't understand is why HTC was allowed to buy the high-amplitude audio capture mics. It seems like ST Microelectronics is at fault here for selling it.

that's exactly what's going on here, but every delusional windows mobile / Nokia fanboy wants to cry about this and shout "outrage", please give me a break.

Thomson is to blame for sure, but HTC is also at fault. In north America,if I buy stolen property, I will be charged with possession of stolen property,even if I didn't know I bought stolen goods. HTC has a duty to do their DD before sourcing components to make sure whatever they're buying is compliant with the law,and doesn't infringe on the intellectual properly of third parties.

Didnt say HTC wasnt at fault. I said STM is more to blame than HTC if HTC knew nothing about it.

The Plus side of the coin is everything has just become fair game here.

1. Microsoft can now use the A6 chip because someone will sell it to them.

2. AMD can use the Nvidia chip sets in graphic cards, because someone will sell it to them.

3. Apple can use Hyper-V code from Microsoft, because someone will sell it to them.

Look, Nokia designed and paid for exclusivity of that product. They went to the courts to get that product, that they own, sales stopped to a competitor.

So now it is Nokia's fault that the competitor cannot meet production times?

1. Forget the article. Just look at the differences in craftmanship. Nokia looks like a hand crafted beauty. HTC looks like parts glued together in a sweatshop. It is funny because 720 is a mid range phone while HTC One is a flagship one!

2. HTC is disappointed that the court ruled they are basically thieves? This is a new one.

As much as I love my 920, I think that's stupid. You can't judge craftsmanship when a 3rd party opens a handset. HTC One should be more densely packed and it's possible whoever opened it, made a real mess.

i'd actually suggest you give me context of what you mean by that,my reply you quoted was agreeing with Anaron that Nokia should stop complaining if their contractor of 3rd party chips go defy an agreement and sell the same tech to the competition. Personally I don't know why all the WP lovers are so heart grip, i mean can all of you be so attached to something so materialistic? Who cares? its stupid, superficial BS all just a load of nothing, and for what? Suing companies who leech more than you want to in the market? Grow up Nokia, your phones are average at best, at best. Did you see the third post on this thread? It was made before any of the "WP/Nokia fanboys" replied. It accused Nokia for litigating because they can't compete. As far as I can see, all replies afterwards were about calling him out and pointing out that Nokia was suing because HTC One used their technology without permission. Nokia is not at fault for asking to stop selling a device with their technology inside. I think anybody in their place would have done the same thing.

You are doing the same mistake in your quoted post so I guess it's pot calling the kettle thing.

It's so funny when you see those who are losing in the market whining and suing everyone instead of making better products.

It's sad.. Microsoft, Nokia, Apple etc.. we now see why we NEVER EVER should allow these companies to have any kind of dominance in the market... They are all terrible companies.

Nokia wins ban in the Netherlands on HTC One component

Nokia has won a court injunction banning HTC from using microphone components in its flagship HTC One smartphones.

It will create more headaches for the Taiwan-based firm, which has struggled with component shortages.

Nokia said it had taken apart the HTC One and found the high-amplitude audio-capture technology was the same as its own.

HTC said it would be looking for alternatives "immediately".

The ruling made by the Amsterdam District Court is effective until March 2014 and will prevent STMicro, which sells the parts, from offering them to HTC for sale.

The court found the parts had been invented by Nokia and manufactured exclusively for the Finnish company's phones.

Nokia said: "HTC has no licence or authorisation from Nokia to use these microphones or the Nokia technologies from which they have been developed.

"The injunction prevents STMicroelectronics from selling the microphones to anyone except us, anywhere in the world, until 1 March 2014. Its scope is not restricted to the Netherlands.

"The HAAC [high amplitude audio capture] technology used in these microphones is Nokia's and there is no alternate supplier."

In a statement, HTC said it was disappointed by the decision.

"We are considering whether it will have any impact on our business and we will explore alternative solutions immediately," it said.

It turns out STMicroelectronics was at fault. They're banned, globally, from selling the mics to any company but Nokia. HTC is going to have to find a new mic manufacturer but they're still allowed to sell current HTC One smartphones.

Probably not disappointed in the decision (or with STM), rather than their sales had been halted on new devices and what STM did. They have not been doing so well so i would be disappointed as well with another road block.

Nokia did make a better product and now companies like HTC and Samsung are copying them rather than innovating themselves. The HTC One is nothing more than a cheap knock-off of the Lumia 920.

Subjective to say the least. I personally think all of the Lumia phones are overrated crapware.

I'm pretty sure HTC is disappointed that the ruling went against them. There was actually a defense put forward. And I'm also pretty sure they knew it was Nokias mics from the beginning. Just look at this comment from Thomson, this tells you everything you need to know.

they didn't stop them from selling phones they already made, just from continued use of the mic in future production.

And that's how it should be. STM is fully at fault here and HTC should replace the components in new phones. This is good news.

I don't see how it is good news - this phone is already plagued with delays, and is now 'banned' in Netherlands. They'll have to quickly pick a new manufacturer, perhaps do some slight modifications to the phone, meanwhile pushing this new 'model' to the assembly lines - bottom line is this is going to cost HTC. STM screwed them big time.

I wonder what alternative they will use and how this will affect price, performance and how will they market it.

They will be forced to use standard microphones from some sort of supplier. So in other words, more inferior microphones which they will no longer be able to market as having "superior sound quality". This will be an impossible marketing situation for them, as average consumers won't know whether they have a One with the Nokia mics or not, and some will probably complain if they see the marketing and then found out their One doesn't do that. They'll have to change the marketing quickly to minimize those situations.

Nokia is the only one in the world that has developed high dynamic range microphones for use in smartphones, and STM is the only company in the world that supplies these microphones, and they are only allowed to supply to Nokia, until their exclusivity agreement ends.

Of course they knew, what they couldn't possibly know is the length of the exclusive agreement between ST Micro and Nokia since it was signed under a NDA.

Turns out that they have the exclusive for another 6 months, apparently.

I'm guessing even after that they would have to pay a license to nokia for the patent of their technology.

Maybe not, if ST Micro has a license already. You don't pay twice for licenses.
