Infitiny Auto Insurance Scam?

So three weeks ago me and my partner got into a car accident. This guy was drunk and hit a car (barely scratch it) but he was scared and decided to flee the scene and that's where he hit us really hard (insurance says it's over 10K to repair the damage). He then decided to leave the scene again but the impact was so big that the car broke down two blocks away. We followed him, took pics, video etc. He went to jail that night. We are both insured by eSurance but decided to use his insurance to cover for the repairs, etc.

Today, my lawyer (who happens to be my father-in-law) tells me he spoke with Infinity Auto Insurance and they told him that the drunk guy's car had barely any scratches (we are talking about a car that broke down because the whole front part of the car was destroyed). Then they told him that the person is probably not insured (probably after he told them we had plenty of evidence). I went online and decided to look up information about the company and pretty much everything I hear is the same story. The company makes up whatever excuse to say they are not paying.

So here's my question... If this company has been doing this for years, who polices them? I already checked the BBB and of course they don't recommend the company but where does it end? How many people have to complain / sue in order to stop companies like this scamming people? :/

Sorry for the rant, it just really frustrates me when companies do this. Anyone here with a similar experience?

I know no one cared :rofl: but things haven't changed. The insurance keeps saying that the car was fine when they went to see it (calling us liars) or that the guy is not insured (even though our insurance said he does have insurance). Now we just found out that the guy had around 5 violations and he pleaded not guilty to all of them (I'm guessing everyone does this?). Seems pretty stupid when we have evidence but I don't know how this works and our lawyer will handle that. :/ Also we will probably have to go to court as witnesses. See you in court &*^*^%&^*(! :angry:

I don't know how much it will help, but usually in every state there is a state agency that regulates the insurance company's and deals with consumer complaints like yours. You may want to try to find out the name of that agency in Florida (If your Location is correct) and give them a call and see what they have to say about this company and any recommendations for you.

there are no laws in florida, should have just stood your ground and killed that mother on the spot. you probably will get sued and you will sue them and in the end 10k damage will cost you 20k in fees and time. and thats how the insurance game is played.

Thank for the info. I will probably also file a BBB complaint (to add to their list) when this is all over.

lol, not sure about where you live in Toronto but there are laws in FL. Now what I don't get is how can you be such a liar and say you have are not guilty when we have plenty of evidence and we have many witnesses. I guess he was hoping we had 10K floating around and we were not going to file the report or that we were not going to show up to court. :no:

If you have proof, then you have nothing to worry about. But keep in mind that if this goes to court, if you ask for $10k for the damages, your attorney is going to take half of it in fees, so you'll get stuck with a large bill regardless.

Since that insurance company seems to have a repeated bad record, it sounds like a class action lawsuit would be appropriate.

I actually work in the insurance industry... maybe I can help some....

Was there a police report filed? If not, why didn't you? that Is the first thing you need for an insurance claim if you are going to claim he was drunk driving, are you sure he was drunk? if so did the cops catch him and prove he was above the legal limit? Did the cops cite him for hit and run if they did get him?

Secondly, did you report this to the insurance as soon as possible?

Even if he had no insurance, what is your insurance coverage? You have Insured driver, underinsured driver / uninsured motorist... if you have the "state minimum" coverage, you might be screwed for the costs to you, because usually there is just enough money there to help the other person, or only cover the other persons property and not your own..

Florida has a $10,000 personal injury and body liability requirement is set at 10/20 aka they pay them $10k min and $20k max, but for you, zip...

what was your coverage set up like?

Any updates on this? Im in the insurance industry as well and if there is no resolve you should contact the Department of Insurance in your state. Inquiries by the DOI usually have to be responded to in 14 days by the insurance carrier. I work for (what I consider) one of the top of the line insurance providers so I just know that inquiries like that are responded to very quickly.

I think in some cases that I have heard of, drunk driving is a contract breaker with the insurance company. Probably depends on the company and regional laws and regulations.

Yes we have proof (pics and videos). Also of course I called the police and there is a police report. The officer didn't report him for hit and run (not sure why) but he gave him a DUI, reckless driving and property damage. He also did not agree to take the sobriety test and did not have his insurance info with him. When the officer asked him for his phone # he could only give him like 5 digits (he was that drunk).

@neufuse We are covered since this is a new car we had to get the most expensive policy (and I'm glad now lol). I'm going to see what happens this week, but if the other insurance company keeps running around I'll just use mine and I'll let them handle the rest.

@Astra.Xtreme he is family so I don't think he'll keep it :).

@jerzdawg that's my luck... the drunk guy had to have the worst insurance company :p.

Doesn't the losing party in a lawsuit usually have to cover legal fees over there ?

over here it's almost always damages+legal fees.

wait, use yours? did you report it to yours or did you go to theirs and make a claim against him? you should always report it to yours and have their lawyers / agents deal with the ordeal you shouldn't have to do anything but report to your insurance company the accident, police report numbers, and any info on the other party

over here it's almost always damages+legal fees.

yeah, the other party's insurance will pay out for damages or if they don't have enough insurance your's will cover the difference, if it doesn't then you have to either sue the insurance company for more (if your own, you better have a full tourt policy that allows you to sue them) or sue the other party directly for any remaining fees if insurance doesn't cover it on either party's end

and what do you mean by since this is a new car you had to get the most expensive policy? nothing makes you get the most expensive policy, usually policies for new cars are cheaper due to safety features, ABS brakes, anti-theft, etc.. you legally could of still gotten the state minimum coverage with a brand new off the assembly line car. What you take out is a personal choice past the mandated minimum.

Now... this is where the confusion lies.

Apparently there are two cars with the same VIN number (same identical cars). Of course this probably means one of them is fake. This is why they were saying the car was in perfect shape, because they were looking at the other car. We just found out he other car is insured by another company (thank goodness) and that the driver doesn't remember anything :rolleyes:. I guess things are either about to get more difficult or easier. We'll see.

Same VIN? Only real way that could happen is if someone made a fake VIN plate... or the Mfg screwed up when making the plates and printed one twice... but I don't think that really happens that much as it's all automated... if someone copied a VIN then they can figure that out through serial numbers all over the car that should match it in the mfg's databases

Did you talk to your own insurance company about the situation, it's pretty typical for your insurance to now pay out then sue the other insurance company for the at-fault claim.
