unless of course, if he had licensing aggreement beforehand (which i doubt) ...
im pretty sure you can get sued for using someones likeness and personal attributes,especially for commercial purposes.

Not really, according to the kickstarter rules, he's breaking them. he should have used etsy or one of the other kickstarter like systems that is about selling the final product.
