You are standing at an ATM in public - do you lose the right to privacy over your PIN ?

That's not an privacy issue, at least I don't think so. If someone watches you and obtains your PIN number that is stealing, a whole 'nuther issue altogether it seems to me. It'd be like someone taking your phone or your wallet in public.
