Question on phone contract uk

Took out a contract with a company, sent the phone back within 3 days. Contract cancelled.

However they kept billing me for a contract that I don't have. Would this classed as theft? Since they are debiting from my account without permission.

I don't have The phone, no bills, since its "not a proper contract".

The company is just taking ages to sort it out, wondering if I should get a lawyer involved :S

Which company? Direct through the network or through a reseller like cpw?

You should have some sort of cooling off period though may incur some sort of charge but only for shipping etc.

Cancel the DD and ask your bank to stop the payments, they should refund you. How long has it been going on?

Cpw. I took it back to the sort and they cancelled it all. Six months later I noticed monthly debits from 3 (which turned out to be not my normal contract another one!)

?42 a month. Spoke to three they said speak to cpw. Who I did, but they just seem to be taking ages! It been nearly a month and they seem to be dragging their feet :(

My advice is that you phone up cpw and ask to speak to their supervisor, and then discuss the situation with them. As soon as something is pushed up the chain faster the better. It's not being an ass or anything, you just want it sorted out ASAP :).

 

I can speak the above my personal experience with 3 and TalkTalk, among other companies! Trust me it works!

Stick to your guns, you cancelled within the cancellation period. You can also ask your bank to demand the money be returned. That'll force the company to investigate the account. If you're in the right. It'll get fixed quick, as they're going to want that money back. (Which will not happen if you're in the right)

Just call your bank, ask them to cancel the direct debit and refund all payments taken under the direct debit guarantee.

This, the direct debit guarantee protects you on this. If you want to see where you stand before hiring a lawyer, get some free advice from your local Citizen's Advice Bureau, they have drop in times (no appointment necessary) and the advice is free.

CPW are a shocking company to deal with, i worked with t-mobile in the complaint team and there was more CPW complaints than anything else

 

Nothing else you can do but keep on their back

 

Do as djdanster said and ask for a supervisor

 

Log a formal complaint with them and tell them if not resolved you will be contacting ofcom

 

Have you had any bank charges due to these payment? as they should also sort that out too

Welcome to Three, where contracts last your life ;)

 

4 years ago I lost my job, was way out of my Three contract period and rang them up to cancel. After the cancellation period came and went, they were still taking DD from my bank. Called them up again, they had no record of me cancelling. Went through it all again, and once again after the notice period was up, they were still taking DD from my account.

 

Cancelled the DD through my bank, then got sent a paper bill in the post, after ringing their awful Indian customer support for the 3rd time and explaining, we came to the agreement I would pay the paper bill and never be bothered again (my mum paid it via cheque).
That still wasn't the end, a month later they sent another bill.

 

After ignoring the bills and moving house twice, they still seem to want to try and bill me, even after 4 years I'm getting sent threats through the post about paying up or they'll send people to collect it.

 

My only fear was it would ruin my credit rating.

called them up and after a number of conference calls with three and cpw. I now have to wait till august till 3 can generate a bill and then send that over to cpw for them to pay for everything. till then i have to wait and hope they all sort everything before it goes to default on the payment
