The minimum he should get is a Wet and Reckless but in all honestly he deserves a DUI and should have the book thrown at him for all his antics. I apologize to all who I made a fuss with, apparently you can slap me and call me sally "Zero Tolerance for Drivers under 21 Florida has a Zero Tolerance law for drivers under 21. This means that any driver under 21 that is stopped by law enforcement and has a blood alcohol level of .02 or higher will automatically have their Florida drivers license suspended for 6 months. Or perhaps the reasons the officer used to qualify that there was reasonable suspicion to conduct a field sobriety test were not good. That is typically how these things get thrown out. Once a lawyer has established that the pull over was unjustifiable and/or the field sobriety test was unjustifiable, then it really doesn't matter what evidence they collect after that fact: It is all thrown out.
