Neowin and The First Amendment

To everyone say neowin's not based in the US...I thought it was a US company based in MI? Has it moved?

The box that everything runs on is in Michigan. The content is all over the place. :D

compared with most other websites and forums neowin is amazingly liberal. as someone who likes to troll now and then a bit for the fun i know this. usually its an immediate ban or ban after a single warning. here on neowin its usually just a discussion with a moderator.

please keep it that way!

That being said, it's a little childish to create a whole thread because of a disagreement in another thread.  It's the internet.  Get a thick skin and move on.  If someone has views that are that diametrically opposed to yours arguing about it on a forum will most probably not change them.

 

Please re-read and attempt to understand.  I stated, this is NOT a continuation of that argument (which was pathetic anyway), it prompted the thought and discussion.

 

But hey, well done for bringing it up and spilling it over!

I did read your original post and it's pretty transparent.  It's not about thought and discussion.  You're basically calling on Neobond to come in and declare that the First Amendment holds no ground here (which is true and has been discussed before) because of "trolls and idiots" that post things and hide behind it.  In other words, "please prove me right."  There is too much in your first post that references your "argument" for it not to be considered.

 

Furthermore, if this was really a thoughtful discussion between mature adults you wouldn't resort to sarcasm in your reply.

If you read it with your personal bias, then that's your call.  What you see is not what is.  It was clarification as well as discussion.  I mean, OK we're not afforded any USGov laws or liberties here - but people seem to assume we are at their behest should something terrible be posted.  Don't project your BS onto this thread.

Well, someone's house is technically private property so if the owner (strangly) allows those acts, then I guess they wont have to leave, even if those acts would be ilegal in public property.

Back on subject, Im suprised that someone would think this:

The First Amendment (Amendment I) to the United States Constitution prohibits the making of any law respecting an establishment of religion, impeding the free exercise of religion, abridging the freedom of speech, infringing on the freedom of the press, interfering with the right to peaceably assemble or prohibiting the petitioning for a governmental redress of grievances.

Applies on Neowin. That is the US constitution. Neowin is not (completely) based in the US.

No it does not.  The US constitution does not hold any weight on Neowin, a company that is formed and runs from (I believe) Europe.  Just because a server is hosted in the US does not afford any constitutional amendment rights.  As clarified by global mods.

It doesn't matter if it was US based. It has absolutely NOTHING TO DO with private individuals. I can kick people out of my house for saying "hammer" if I want to.

If Neobond is available, I think perhaps it may be worth his while explaining how the US First amendment has bearing on Neowin.  As a privately owned site, outside of US jurisdiction - I've seen a few idiots and trolls post nonsense and then attempt to hide behind their US rights.  Do they apply here?  Or is Neobond's word, the final say here (as I assume it is and should be).

 

The First Amendment protects people in a US territory from being censored by the US government only. Neowin being a private entity, its users have no free speech rights. Neowin owners can define what's allowed and not allowed to be discussed, even if Neowin was an American company or based in the US.

We aren't a government - state or otherwise. Our rules aren't laws, they're rules for the site. This has nothing to do with trespassing. If you're escorted off of Neowin premises and you return you technically ARE trespassing. Also, law enforcement officials can order people to leave a public place.

I don't know how many companies I've seen sued in the USA over "violating my first amendment rights" and them not even understanding what the 1st amendment says..... basically all those lawsuits end in the judge saying it's a private entity, they can make their own rules, they are not subject to the 1st amendment as they are not a government entity

I think you guys misunderstood me; What I ment is that noone in the world should consider that Neowin, a private company, has to amend by the US constitution. It shouldnt and, like confirmed, doesnt. It is free by its own rules*

* - To a extent.
