House Speaker John Boehner could file a lawsuit against President Barack Obama in days, in an attempt to challenge the administration's heavy use of executive actions to further its agenda.

Roll Call's Daniel Newhause reports Boehner told House Republicans during a closed-door meeting on Tuesday he could have an announcement in the coming days on whether he will mount the legal challenge. According to the report, he has been "consulting with legal scholars" ahead of his next move.

Boehner's office confirmed the Roll Call story, but declined to comment on whether specific executive actions would be targeted. Any legal action by Boehner would be a significant and somewhat unprecedented challenge to executive power.

Obama, however, has given House Republicans plenty of potential material. He has made 2014 a self-proclaimed "year of action," issuing executive orders on everything from the minimum wage to federal pay discrimination. Perhaps the most controversial administrative-only move this year came in the form of newly announced regulations from the Environmental Protection Agency on carbon emissions.

"Heavy use"

Obama has issued around 200 orders while he was president, compare that to nearly 300 under Bush, nearly 400 under Clinton, and 3,522 under FDR. But yes, Obama is the only one abusing it

Frivolous lawsuit and waste of taxpayers money while failing to address the real issues of the country; unemployment, health care, economy regulations, environment, violence, ...

Obama's over use of Recess Appointments is already before the Supreme Court (and he's likely to lose) so, yes.

It's not how many orders (most are routine) but what he's doing with the rest - violating the Separation of Powers by legislating from the Oval Office. Changing laws by decree, ignoring other laws (even ones he's signed), creating "laws" by decree etc. That's a no-no.

I guess not other Republican president has done anything similar. Obama is the only evil president that this country has.

Poor baby, Obama has gotten around your do nothing Congress and you're upset about it and now want to sue so you can continue your track record of doing nothing but trying to appeal the ACA.

If you were a unbiased Congress and did the right things you wouldn't have this problem.  Your own actions brought this on.  Deal with it.

Well Congress has been a stalemate for a bit now, no reason for Obama to believe something will get done fast. Republicans just want him to go through them so they can veto or filibuster.

If Congress could actually do their jobs then he wouldn't have to go around them

Every president uses Executive Actions but the black guy can't do that.

That what I hear the GOTP saying.

Maybe he should stop using the Hastert Rule and let things come to the floor other than Repeal Obamacare Part Infinity.

NO laws have been changed by the president. No decrees have been issued unless you're talking about stuff like the prisoner swap. You do know that Guantanamo Bay is a military installation? Guess who's in charge of it?

EDIT: For Jason: http://www.presidenc...data/orders.php

I'll sing for joy when Obama is gone -- and not because he is 'black'.

I didn't like Bush II either.

FDR was in office for a very, very long time, before term limits were imposed.

Well maybe if the god damn Congress could stop acting like 10 year olds at Chucky Cheese's and get something done, maybe the evil Obama wouldn't have to resort to such "drastic" acts. Even though they aren't that drastic, or unheard of. But whatever.
