Police shoot Denver teen who struck officer with stolen car

Recommended Posts

Denver police shot and killed a 16-year-old girl who allegedly struck and injured an officer with a stolen car early Monday.

Authorities did not identify the teen who was shot, but friends identified her as Jessica Hernandez.

Police said that one officer was responding to a call for a suspicious vehicle in an alley at around 6:30 a.m. local time. A second officer arrived after it was determined that the car had been stolen. In a statement, police said the two officers then "approached the vehicle on foot when the driver drove the car into one of the officers."

White said both officers then opened fire. The officer hit by the car was taken to a hospital with a leg injury.

Authorities said that there were four other people in the car with the victim. None were hurt, and all were being questioned as part of the investigation. It was not clear whether any of them were arrested.

Bobbie Diaz, whose 16-year-old daughter was in the car, said she was lying in bed when she heard four gunshots followed by an officer yelling "Freeze! Get out of the car! Get down!"

Diaz said she came outside to see officers with their guns drawn pulling people out of the car, including Jessica.

"She seemed like she was not responding, not moving," she said. "They just yanked her out and handcuffed her."

Meanwhile, Diaz said she heard another person screaming "She's dead! She's dead!"

"I'm just trying to process everything. I'm just heartbroken for the girl's family," Diaz said. "How could something like this happen again?"

So, she runs down a cop with a stolen care and cops are to quick to use a gun?  They have rubber bullets and stun guns?  Yea, I am sure those will go through a window or windshield and the girl was using the care as a deadly weapon.

Most cases I've seen from police shootings (I'm talking about amateur videos), it's always the suspect not complying to orders like "stop, don't move".

I mean, if I was a police officer, and someone moved menacingly at me after I said "stop, don't move", I'd shoot him/her.

isn't trying to run someone over classed as assault with a deadly weapon?

The question I have, was said person shot as they drove the car towards the cops, or as they were driving away?

If it was towards, you can easily argue it was in self defense, if it was whilst it was driving away, then you have to weigh up what sort of risk they are to others if they get away.

Given the article above, I'm inclined to assume that it was as they were driving towards them.

Yep, that's what i got from the article, especially as it stated she drove the car in to one of the officers.

It's gotten so the cops don't have much more of an option other than to shoot first and ask questions later. Not much of choice when you're about to be ran over by a car anyway!

Kid's these days don't understand the consequences of their actions.  They have no discipline and no real fear of anything.  They don't understand consqeuence.  Sorry has always worked before.

Wow. I'm so relieved by your replies. I though this thread would turn into a cop bashing one once again!! Finally ppl are starting to understand police work and how the use of force works.

This is what is pushed on us at school throughly over the years

Why is the girl referred to as "the victim" in the article? She hit a cop with a stolen car. "Alleged suspect" I can see, but she's clearly not the "victim" in this case!

I guess the media has just decided that ANY use of force by the police is unjustified these days.

Exactly, Police are trained to do this when assaulted with a deadly weapon. Sure we can argue that some things need to change with police force, but its not going to happen overnight. These guys have years of training that have taught them to respond like so if threatened .

The biggest difference and I think this is where people are bent out of shape. Usually if an officer kills someone in a situation like this, he gets off pretty easy in the minds of others. Where as if this were a normal person, there would be a trial of self defense vs assault with deadly weapon

Most self refense laws do not specify this. The rule is if you perceive yourself in danger of serious harm or death you can fire, and firing in the defense of a third party being attacked or sexually assaulted is also permitted.

In cases where some bozo runs down one of your group then continues acting in a manner where more are in danger the right to fire is triggered. Odds are very, very high the District Attorney takes one look during the incident review and calls it a good shoot, cop or civilian. Unless, of course, Al Sharpton, Holder, Jackson, Obama etc. get flapping their gums. Then it becomes a political circus.

Wow, I guess you never used a mobile device to make a reply to a post.  And a comment just for that?  Really?

Don't do it that often so it didn't cross my mind, just though you were tired at the time. As for commenting about it, why not? Anyway, the intent wasn't mean-spirited.

That is terrible. The officer was justified but that is just sick.

She got what she deserved.  Nothing "sick" about it, just sweet sweet justice.

Vehicular manslaughter is no laughing matter. The girl used the car as a weapon.

EDIT: Seems I misread your comment here. Still my comment stands. The cops see vehicles as weapons. If you charge them with it, they will draw, and fire.
