Supreme Court Says Use Of Lethal Injection Drug Is Legal

The U.S. Supreme Court, in a 5-4 opinion, says the sedative used in Oklahoma's lethal injection cocktail does not violate the U.S. Constitution's ban on cruel and unusual punishment.

Here's the background to the case, in the words of SCOTUSblog:

"As part of its lethal injection protocol for executions, Oklahoma uses a sedative called midazolam, which is used to treat anxiety, to make the inmate unconscious. Two other drugs then paralyze him and stop his heart. A group of Oklahoma death-row inmates have challenged the state's use of midazolam, arguing that it cannot reliably render an inmate unconscious.

"The difference between midazolam and other drugs (like pentobarbitol) is that it's not a barbiturate. So the inmates' argument was that it wouldn't cause the sort of deep coma that would prevent pain later in the execution procedure."

Today, the court ruled the death row inmates failed to establish that the use of midazolam violates the Eighth Amendment's ban on cruel and unusual punishment. The court's four liberal justices dissented.

So a bunch of convicted murders are worried that being executed will cause them pain? Hmmm, what if we started executing them in the same fashion that they killed the person that they were convicted of?

Exactly it's amazing to some how little I care if a convicted murderer has pain and discomfort as we are putting him down, its the death penalty advocates fault anyway they have made that drug so hard to come by that states go find alternative drugs that do the same thing and don't work as well...who's fault is that?

Sounds good to me. Or use lye as the drug for the lethal injection.

 

On a more serious note: If someone is dangerous enough, and committed crimes terrible enough warrant the death penalty, then why should anyone care if they experience discomfort in the execution? I don't actually advocate a torturous method of execution (despite what I stated above) but why should their comfort be a consideration? I doubt the convict was concerned with being humane when committing the crimes that earned him the death penalty.

 

Why should the perpetrator get more mercy than his victims received?

I wonder if you all would be as disconcerned for their unsuffering if later found out they were innocent of the crimes they were charged and made suffer a innocent.... how would your consciences cope with that fact?

Same as I feel about the other people that die all around the world? I don't.

TBH some people deserve a cruel and unusual punishment like that Russian terrorist in Boston.
