Demonoid's Return Forces Canadian Users Out

Earlier reports suggested that Demonoid was contacted by the CRIA, but with Demonoid's return, fiction has become fact. Demonoid reports: "We received a letter from a lawyer representing the CRIA, they were threatening with legal action and we need to start blocking Canadian traffic because of this."

The bad news of course is that Demonoid is now unavailable to Canadians. Unfortunately it is not the first time an anti-piracy organization has effectively shut down access to a part of the BitTorrent community. Earlier this week Isohunt had to ban US users from its trackers, and last month TorrentSpy blocked access to US users, both by pressure from the MPAA.

I was wondering about that. It's technically impossible to block someone. Ironically Burma is pulling the same stunt but for a different reason. But hopefully smart nerds in that country will figure out how to get around that block and still get the video and pictures that the govt there doesn't want outside.

3. How many people from outside Canada go to Canadian universities? Not very many. US universities are number one in the world for people from all over the world to study in (another fact). 4. The program you are referring to is made for fun, a bad one (Canadian fun), but fun. The only thing is that it is fun if you make fun of yourself and not others. 6. I was born in Europe (in Greece). I lived in 6 countries in Europe. Then in Canada, Australia and the US. I speak 7 languages. From all the countries (I lived in) if I had to choose one I would choose US or Australia. And as for education... it is higher that in any other country (another fact). You can read about education on world's education sites. You will find that the Americans have one of the highest level in education and Europeans one of the lowest in "developed countries". So I guess the vast majority of Europeans (and Canadians) can't even point to their continent... to point their countries on a map would be too much to ask.

TORONTO - Federal Court of Canada (and former Competition Bureau chair) judge Konrad von Finckenstein dealt a blow to the Canadian recording industry yesterday by not only saying song downloaders could stay anonymous but also that their activities weren't illegal.

The judge issued his widely anticipated decision yesterday to a motion brought by all of the major record labels soperating in Canada under the auspices of the Canadian Recording Industry Association (CRIA) which demanded that Canadian ISPs give up 29 names and addresses of people it said were illegally trading in massive amounts of music downloaded over the Internet. CRIA named five ISPs: Shaw Communications, Rogers Communications, Bell Canada, Telus and Vidéotron.

CRIA tracked ISP addresses and usernames and said that each of the 29 users identified downloaded over 1,000 songs.

However, in a concise, surprising decision, Justice von Finckenstein said the recording industry just didn't prove its case. While all of the ISPs actively opposed the motion in court, except Vidéotron, Justice von Finckenstein called several of the CRIA tactics and claims into question and concluded "downloading a song for personal use does not amount to infringement."

Further, "No evidence was presented that the alleged infringers either distributed or authorized the reproduction of sound recordings. They merely placed personal copies into their shared directories which were accessible by other computer user via a P2P service... . In either case the preconditions to copying and infringement are set up but the element of authorization is missing."

As for the actual tying of ISP accounts with the ISP addresses and usernames gathered by CRIA, Justice von Finckenstein took a dim view of that as well. While saying, "the ISPs are definitively involved with the alleged infringers. They are not mere bystanders. They are the means by which downloaders and uploaders access the Internet and get in touch with each other," he explained that there are far too many variables involved in accurately attaching a months-old ISP address with the proper end-user. While the ISP address will point to the right account, there is no way to identify the person sitting in front of the computer when downloading and uploading was happening.

"Under these circumstances, given the age of the data, its unreliability and the serious possibility of an innocent account holder being identified, this Court is of the view that the privacy concerns outweigh the public interest concerns in favour of disclosure," reads the judge's decision.

"That is exactly the position that we took in court. We spearheaded the initiative to protect customers' privacy rights and we think that was the right thing to do," said Peter Bissonnette, president of Shaw, in a statement.

CRIA, however, is not deterred by the decision. "We remain committed to our plans to enforce the law against unlawful 'file sharing', which is devastating the entire music community. We will continue to fight to protect music creators from the theft of hundreds of thousands of songs," said CRIA President Brian Robertson.

"We are reviewing the decision received today from the trial court and expect to appeal it," added CRIA general counsel Richard Pfohl. "In our view, the copyright law in Canada does not allow people to put hundreds or thousands of music files on the Internet for copying, transmission and distribution to millions of strangers. We put forward a compelling case of copyright infringement in seeking these disclosure orders. We presented more initial evidence than has ever been put forward in a request for disclosure of user identities from ISPs - which Canadian courts have granted on numerous occasions."

Canada's recording industry has launched several initiatives designed to meet the technological challenges posed by unauthorized online music distribution: from the Value of Music public awareness campaign aimed at the early teen demographic, to direct 'instant messages' to unauthorized file-sharing service users, to the creation of new legal online business models like www.puretracks.com and www.archambaultzik.ca.

if the CRIA is not geting any of the money from the "Copyright levy" then they should take the "Canadian Private Copying Collective" to court and not users or usersites since it is the Canadian Private Copying Collective (CPCC) that collects the "Copyright levy".

Nope. It's 100% legal to copy files through or from any medium for personal use. That's why you pay the CPCC levy when you buy blank media...

You can still use the trackers if u get the torrent file off another site ;)

ive never used demonoid, but im glad to see that the CRIA is doing something, instead of suing everyone on sight, like the RIAA.

Yeah, the RIAA wouldn't dare shut down Demonoid. They'd rather track each individual to sue them, using Demonoid as their own money farm. :P

I pay the CD copyright levy, which compensates artists for the music which I "may" copy for personal use (source is not specified in the law). Therefore, forcing a site to block access to music torrents for Canadians will be a violation of the CPCC copyright levy act, which entitles me to copy music for private use without any impedance. So this can be easily thrown out if it goes to court...

it was up for about an hour last night - just long enough for everybody to go "OMG IT'S BACK GOGOGOGO!" and cause some instability in their setup.

That's okay there are plenty of other BT Trackers out there.

The CRIA has no balls anyhow, just to go to any Canadian Court and the judge will take pity on you and drop the case.

Since the CRIA is probably infringing on the "Canadian Charter of Rights".

I actually can't remember the last time I downloaded something from Demonoid. No loss here.
