Galaxy Tab 10.1 banned in Australia again

Samsung's victory in an Australian court was short lived. ZDNet.com.au reports that today, the Australian High Court has now extended the ban on the sale of Samsung's Galaxy Tab 10.1 tablet in that country at the request of Apple so that another hearing in the case can be held later in December.

Earlier this week, Samsung got the three judge panel of the Federal Court of Australia to unanimously overturn a previous court ruling that banned the sale of tablet back in August. The original ban was set up because Apple claimed that the "look and feel" of the touch pad for the Galaxy Tab 10.1 tablet was infringing on Apple's patents.

Today the High Court decided to extend the ban once again so that it can have time to hear Apple's appeal of the case. A hearing which will determine whether or not the High Court will actually take the case will be held on December 9.

This new decision put Samsung's plans to put the Galaxy Tab 10.1 on sale on hold. It told the High Court that it had planned to start selling the tablet in Australia next week. In a statement, the company said, "Samsung believes Apple has no basis for its application for leave to appeal and will vigorously oppose this to the High Court."

I visited the Android Experience store at the Telstra store on Bourke St in Melbourne today.

They had a wicked setup with the Galaxy Tab 8.9 (i think) and some 3d-controller thing outputting to a 3x3 LCD setup and Google Maps.

I must say, the 8.9 certainly looked the goods! Very tempted to get one now.

Just remember this is a grey ban. Although they can't directly import them and sell them, I believe parallel imported ones aren't affected by this so should be able to get them in small quantities from smaller importing places. Just places like harvey norman and things like that won't be carrying it till this is lifted. Failing that can buy from New Zealand as it's fully available here both 8.9 and 10.1.

Let's just say... if it has flash player, runs dosbox at full speed (quest for glory dos game) it's definitely a good unit. I can't think of another reason to use a tablet than to play retro games on the go and watch the flash tub on SA

Hmm, I fancy in doing something else instead. But, I'll keep that to myself.

Yeah but doesn't all tv look like the same anyway? I mean it's a device that does a thing. It's a tablet, the basic is black vignette with a touch screen. They will look the same..

Samsung should just quote Jobs' "Good Artists Copy, Great Artists Steal." line, that should end the case once and for all. Only then will us Australians be able to choose between an iPad and a Galaxy Tab.

I agree, although they've apparently tried slightly amending the look to appease the courts in some countries? The original is definitely very similar.

This whole idea makes me sick. How can a company create something to be as simplistic as possible and then accuse others of copying them? You made a tablet that was as thin as possible with a screen on the front and included one button. Do you expect your competitors to make the device deliberately obtuse in order to avoid lawsuits? The iPad is a copy of the Microsoft Surface?

How many consumer digital cameras look the same? How many HD Televisions look the same? For God's sake eve the Droid Incredible looked exactly like the iPhone (for good reason which is what made Steve Jobs go ape sh** last February). There is only so many ways one can do a product. The point is, compare what's the same on the inside.

it was steve's dying wish to kill off the android OS. Sadly, even with the billions at their disposal - they are only able to screw samsung over in Australia.

Honestly the shape and feel means nothing. The shape and feel of their tower macs reminded me of my first PC, Their cube infringed on a lot of copyrights... and their basis is they designed the 'tablet' which looks like a plastic sheet in drawings and contains no other technical info to differentiate it from what was aired in the 60's in Star Wars.. so honestly, they stole that design too..

I like some of apples products just not the way they do business, they like to look squeaky clean but everyone sees that when it comes to competitors there is no clean fighting for them "Hi, im a mac and i dont get viruses...yet", "Hi were apple and we dont like your product it copies ours too much even though we stole alot of ideas from others".

That was a trademark thing rather than a copyright/patent issue. Which is why they just renamed to Linspire and carried right on.

The case should be thrown out, and Apple charged with perjury since they doctored evidence
using images of the Galaxy Tab they made to look more like an iPad than it actually does.
