The cold, HardOCP's lawyers have won a ruling in their case against Infinium Labs. The ruling essentially forces Infinium and the company's founder, Timothy Roberts, to produce a boatload of information. The info required includes documents about Infinuim's business dealings in Texas. That's notable because Kyle and the gang are trying to get the trial moved to Texas, where costs and conditions would be more favorable for the [H]. However, the possibility of the PStwo emerging in October remains firmly in the realms of speculation, and a number of factors would seem to weigh heavily against the rumour - not least the fact that Sony hasn't announced anything in either the USA or Japan as yet, only six weeks before the suggested launch.

While that timescale isn't impossible by any means - the company cut the time between announcement and launch of the PSone quite fine as well, presumably in an effort to sustain sales of the original console for as long as possible - it's worth noting that the PSone didn't arrive until the launch of the PlayStation 2, and was seen as a repositioning of the console away from the new platform's market space.

With PlayStation 3 still over a year away, and PlayStation 2 still selling strongly, it would seem like an unusual move for Sony to roll out the PStwo ahead of that schedule - although the company may do so in an attempt to ensure that PlayStation sales remain firmly ahead of the Xbox in North America.

The timing would also, as McNealy points out, give Sony a "one-two punch" - launching a new console design alongside the biggest title of the year, GTA San Andreas, only weeks before Microsoft rolls Halo 2 out to retail.

I'm in a little of turmoil from one hand I dont like [H] and on the other hand I dont care much for Infinium "labs" so I guess... oh well I hate [H] more - this is bad bad news

How can you hate HarOCP. They are one of the only big tech sites where the person who started it, Kyle Bennet, still seems to be actively involved in it. I never see Anand actually doing much of anything on his site anyomre and the same goes for Tom at Tom's Hardware.

how will H get the case moved to texas??? SO infinium made some deadlings in texas, cant they just say they've done dealings in other states?

Infinium originally stated they were based in texas, then suddenly moved to Florida when the lawsuits came outswing. All that would have done was switch it to federal, which would take a dimmer view of the whole mess.

I think Infinum picked a fight with someone who was more than willing to slug back, namely Kyle and HardOCP. Bad move, in my opinion, when Infinum's lawsuit and background aren't the type of thing you really want a good and fair judge looking at. I am happy, however, that they did score the first hit. Preventing companies from going into lawsuit mode to keep their Venture Capital funding going (which is what this is all really about) will be a big thing. Infinum sued simply because Kyle and HardOCP did some elementary research, found a lot of holes and other questionable info about their background, and published it. Something any good paper does on a frequent basis.

I dont see how anyone here is talking bad about [H]. They were just doing their jobs and Infintium sued them, so they flipped it on them and now ppl are calling [H] a**holes

you need to realize that this affects all news sites including Neowin. If Infinium wins, this is bad news. Period. Kyle just did some investigative reporting and Infinium didnt like what was posted even though it was public information and verifiable (the source). So Infinium sued and Kyle called their bluff. And Red Dragon is right, its about the venture capital.

Infinium haven't got a leg to stand on. I remember reading all about this when it first happened, ages ago, HardOCP were absolutely right - then when Infinium accused them of libel HardOCP modified their article to leave only *facts - and Infinium still looked like fools.
