Take-Two Interactive just issued a release featuring details on the preliminary settlement of the consumer class action lawsuit filed against it and Rockstar Games over the "sexually explicit" content in Grand Theft Auto: San Andreas. That content, unlockable via the "Hot Coffee" mod, caused the game to be re-rated by the ESRB, pulled from store shelves, and acted as the grounds for a suit filed in July of 2005 claiming violation of consumer protection laws. The lawsuit against Take-Two is still pending, but should the United States District Court for the Southern District of New York agree to the settlement, claims against the company will be dismissed "without any admission of liability or wrongdoing by Take-Two or Rockstar."

The publisher says that it will pay out between $1.025 million and $2.75 million in settlement benefits, which range from an edited copy of GTA: San Andreas to a cash payment up to $35 for those who can provide proof of purchase of the game from before July 20, 2005. There are, of course, stipulations to the proposed settlement, the details of which are in the full press release below.

So, the video game gave people porn they didn't pay for, and that's grounds for a lawsuit? Who do I call to start a lawsuit against the game developers who didn't give me free porn? I expected free porn, dammit! I've been psychological damaged and emotionally harmed, I say!

Is this still going on!? The 'porn' is not accessible unless you patch the game. The developers obviously removed it from the game by disabling the in-game trigger that reveals those scenes. So unless you really want to see it you never can. Isn't there something in the EULA about not modifying the game code?

I didn't know that you had to patch the game to get it. That changes everything.

and surely if your mind is able to cope with the killing and violence in the game, it can cope with a little bit of porn

OH MY GOD, GUYS IT'S BADLY RENDERED 'PORN' IN AN M RATED GAME!?

Wait.. what's that - it's not even accessible without modding it? Well, everyone knows that the young children who aren't meant to be playing it anyway are all totally technically savvy when it comes to these things.

RUN FOR THE HILLS!

This whole affair is so goddamn retarded it sickens me. America's pron/violence priority list is so screwed up it's unreal.

I know its friggin screwed up, but don't fool yourself into thinking this is only happening in America. There's way too many lawyers on this planet and way too many out of touch parents..those 2 things together equals the end of civilization.

Here, here! That's why over here we've got overprotective "Health and Safety" officials who now ban kids from taking a pencil case to school, because it contains sharp objects... such as a pencil. It's also why we have a watershed.

Three top pen and marker manufacturers — Bic, Pilot Pen and Sanford, which produces Papermate and Sharpie — are making more purple pens in response to rising sales. School leaders and teachers are largely driving that demand, company representatives say.

Why oh why did we americans get the puritan settlement boat. These people got kicked outta england for a reason. Why couldn't we have gotten a cool latin party settlement boat that made friends with the indians?
