Blizzard wins $6 million in court case with MMO Glider

Another chapter of the Blizzard versus Glider story has come to a close. Blizzard and MDY Industries have been going at it over Glider since 2006, in a battle that's been rather important. Not only has it been about Glider doing something wrong, it's been about how well an EULA will hold up in court. That's something the entire gaming industry, especially MMOs, have their eyes on. If Blizzard had lost, it would have had a negative impact across the entire industry.

Blizzard is most certainly not losing. According to BBC News (among other sources), they just won $6 million from MDY Industries, which is less than what was expected of them. This isn't their first victory in the war, but it's the first involving money. Blizzard could still appeal the ruling, so it may not necessarily be over, though I personally think the point has been made as far as damages. There are still further chapters in the story that await, because they'll be in court again in January of 2009 to resolve further issues.

This entire debacle is the perfect formula to rally people on MDY's side here on the internet. Blizzard is Goliath, and MDY is David. People are, generally, going to be on the side of Glider's makers just because siding with the little guy feels more familiar. Personally though, I feel like MDY Industries just got what was coming to them. They broke WoW's Terms of Service, enabled thousands of others to do the same, and they cast the first stone when it came to the lawsuits. They were pretty much begging Blizzard to crush them underfoot. They were doing a jig around the room singing, "You can't touch me, you can't touch me!" and then Blizzard backhanded them across the face.

I don't think that's true at all. Anyone who has played an MMO for any serious amount of time knows that gold farmers and bots ruin the game for everyone. I wouldn't be surprised if the people angry about this are a very, very small minority.

Glider is a bot if I'm not mistaken and was widely used by commercial gold farmers.

I am happy about this ruling as well. As much as I dislike leveling though the same content multiple times, Glider enabled too many gold farming bots to justify letting MDY to continue.

I leveled up a toon using glider almost a year ago. I only did it because I don't like the leveling aspect of the game, just enjoy raiding.

Ya can't really blame both parties. If glider broke the rules then blizzard has every right to sue, but at the same time glider makes the game easier for people who have already leveled several characters and don't want to play through the same thing again and again.

I sold my accounts and don't play anymore. But if glider got totally shut down, another company would pop up with new software.

This sums it up perfectly. Nobody is harmed in this game in any way. People who argue against you will play both sides of the field, too. "Oh, it's so easy to level and get your own stuff. Why cheat?" Then they will turn around in the next sentence and say "Bots make the game hard for other players." So which is it?

If glider broke the rules then blizzard has every right to sue, but at the same time glider makes the game easier for people who were too lazy to play the game and not acknowledge that they were violating the Terms of Service themsevles, and not caring, while they have already leveled several characters and don't want to play through the same thing again and again because they were too busy gaining levels to actually enjoy the game.

With the patches Blizzard has released lately, everything's a cakewalk now. Don't see a point in cheating your way through something that doesn't take much time.

How many hours is "doesn't take much time"?

I think if you have a active life in the real world, then it's pretty hard to leveling a character.

That's hilarious. You couldn't handle leveling a toon in the easiest, most boring MMO on the face of gaming, yet think you deserve to raid.

That sums up the typical World of Warcraft player mentality...I'm amazed Blizzard hasn't added the funtionality to the game where it just plays itself, so you all can just jump right to jerking off to your netherdrakes in Shattrath... lol

That's hilarious. You couldn't handle leveling a toon in the easiest, most boring MMO on the face of gaming, yet think you deserve to raid.

That sums up the typical World of Warcraft player mentality...surprised Blizzard hasn't just made it so the game completely play itself, so you all can just sit around Shattrath in a circle-jerk oggling each others netherdrakes...which is what's -really- important. LOL

No real gamer will cry over that one... there is no justification for using a bot. The excuse of "i just want to raid" is simply ignoring the fact that bots are a pain for all other players who encounter them.

/ban them all

How is it a pain for all other players who encounter them. Before I even knew what glider was when I was playing WoW I'm sure I walked by someone using a bot. I wouldn't have cared. The only thing that was annoying was the gold spam in chat, but after one of the patches it really cut down to only seeing spam once or twice a day, this was like a year ago when I use to play.

I agree, a fact would be... "there is no justification for using a bot, when you accepted the Terms of Service."

What you learn is that, for every person that works hard, there is a person willing to work half as hard and looking to cheat and get ahead of all of them.

It's a good victory for Blizzard, they have successfully defended their IP in a time when, the law is still young on that matter.

The justification for using a bot is: I want to cheat. Plain and simple. No problem, but thrown into a multiplayer game cheating ruins things for the other players. WoW Gold becomes inflated for instance (which affects AH prices). Also, you have to deal with people who "glided" through the game and don't know how to play their class at all. Beyond just how it affects game play, it also diminishes the time invested by other player. Not to say that wasn't time they enjoyed, but there is a sense of accomplishment in saying "I have two level 70's" or whatever when talking to fellow gamers who give a damn.

Interesting how the court upheld Blizzard's EULA. I wonder if this will affect Apple's legal actions against those who are breaking their EULA by installing the Mac OS on non-Apple hardware.

I don't like MDY industries because they are greedy. They wouldn't even make a 64-bit version, saying they were NEVER making one. The only reason behind this would be that their driver would need to be signed, and they are so cheap they can't pay for that so NO 64-bit version.
