Tamatha Tovar bought her son a late Christmas present over the Easter weekend, a brand new PSP from Wal-Mart in Manatee County, Florida reports myfoxboston.

When 6 year old Eliso turned on the PSP for the first time however, the background had been set to a picture of a naked woman. Frightened he would be grounded Eliso ran to his mum crying to show her. Tamatha then found a memory card in the PSP filled with pornographic material which she claims is not hers and was already in the box.

In shock Tamatha phoned Wal-Mart asking to speak with the manager and explain the situation.

"I explained the situation and his response was, "well, bring the machine down and we'll let your son pick out a new game," Tamatha then continued to say "and I was like, no I don't think you heard what I said."

A spokesperson for Wal-Mart has said they are looking into what happened and they were concerned over the matter. Ms Tovar has told Wal-Mart she wants a new PSP to replace the one she bought and an apology from the company.

Cases like this are sadly not unheard of and it was only in March where Sony received bad publicity after a Kentucky man was accused of trying to persuade an 11 year old Humble girl to send him nude photos while they played games online together. Neowin's Garrett Dodd covered the story back in March.

She bought something that was obviously a return then. Swapping it out for one that wasn't messed with isn't an unrealistic expectation. Albeit, this incident isn't really that bad as it was just a naked woman. Be glad it wasn't goatse.
#2.1 _X_ on 15 Apr 2009 - 03:04
hahaha goatse.

I'm more shocked the mum knew how to access the memory card.

why should walmart have to apologize? Unless they reboxed a used returned one as new, they should have no fault in it... if the thing came that way from sony, then it's sony's fault
#3.1 Airlink on 15 Apr 2009 - 18:35
Ummm. they obviously DID rebox a used return as a new one. Sony doesn't just give away free memory sticks, you know.
#3.2 Gladiatorus on 16 Apr 2009 - 05:04
It's Walmart's fault because they sold the product. If it was a used PSP that was re-boxed as a new one (without checking it), then it's even worse...

I just fail to see why this is a big deal. Yeah, they gave her a returned item (which is kinda dirty if it was sold as new), but they offered a new game, and I'm sure they'd have no problem accepting the PSP back either. A "sorry" from a faceless corporation (or some random dude in mangement) is about as worthless as things get - why the big fuss?

Oh right; Fox news. :-/

Better than CNN with their "More women are having sexual dreams about Obama than ever before" stories.
#4.2 C_Guy on 15 Apr 2009 - 14:58
You fail to see the big deal? Porn isn't intended for 6-year olds. Let us know if you require further explanation.

I agree, I don't really see a big deal about this. Wal-Mart was dirty, and gave them a return product, bleh.

Doesn't surprise me...

A small company I used to work for years ago purchased a Packard Bell PC from a popular electrical retailer in Australia. After a week of using it the thing died (motherboard). They ended up getting a replacement PC. A few weeks later we get a call from a woman who just purchase the same model PC from the same store and find all our company data on the PC. Needless to say the retailer was sued...

It does happen!
#7.1 Solid Knight on 15 Apr 2009 - 03:22
Always wipe your PC before giving it away.

I once worked in a store doing repairs. It's funny when you're working on their PC and stumble upon their homemade porn.
#8 +warwagon on 15 Apr 2009 - 02:47
Good thing it wasn't pictures of her

I bought a used zune from a girl off craigslist. I met her right in front of walmart where she worked, she had all the badges and out fit on. I got it home it had like 6 porn movies on it. It also had pics of some guy with his girl, not porn. It looked liked i bought a return because not one picture was of her. Im glad i cleared it before i gave it to my son of 13.
#11.1 EchoNoise on 15 Apr 2009 - 04:23
You cleared it up after you backed it up right?
#12 Shiranui on 15 Apr 2009 - 03:53

So thats what happened to my memory card.
#15 +Frazell Thomas on 15 Apr 2009 - 04:42
Yawn. Just delete and move on... I guess everyone is out for something for free these days.
#16 SoulEata on 15 Apr 2009 - 04:43
What is she expecting from Walmart? They didn't open up the box, put in a porno memory card, re-seal it, and put it on the shelf.
#17 +warwagon on 15 Apr 2009 - 04:48
So let me get this straight. The kid got a free memory card and free porn?
#18 max-pain on 15 Apr 2009 - 05:12

Humm is anyone else besides Fox reporting on this.. I would not trust this story if it is just coming from FOX. I think they still have McCain ahead in the polls.

Holy crap! I hope he wasn't scarred for life by all that evil nudity. :p

He saw a naked person? Oh my god! Is he ok? I hope the paramedics got to him in time.

This country is so screwed up.

#25 cork1958 on 15 Apr 2009 - 10:45
Yep,
She's eagerly awaiting her lawyers response to the possibility of suing for irreparable damages to her kid, plus false advertising, as the unit wasn't new.
#26 [DGS] on 15 Apr 2009 - 11:03
most probably was a PSP that someone else returned and they didnt bother to check the memory card before re-selling it
#27 Webworldx on 15 Apr 2009 - 11:06
That reporter was hyping it up too wasn't he. Like he was covering an earthquake story. Had to watch it with the sound off as couldn't stand him.
#28 Orange on 15 Apr 2009 - 12:43
He needs to learn porn one way or another lol
#29 NeoandGeo on 15 Apr 2009 - 14:05
I think a free game is a perfect compensation for a simple problem. She is trying to get it hyped up so she can get money. Possibly so she can keep hording food from her son, from the looks of it.
#30 Zoom7000 on 15 Apr 2009 - 14:29
Erm... ever heard of format? I never brought a PSP, but if they don't come with memory cards as standard he got a free memory card with his, he should shut the hell up and get on with it! :p
#31 C_Guy on 15 Apr 2009 - 14:59
This is hardly a new story. How many times do children have to see porn on a "new" device before companies start implementing procedures to properly erase data from returned devices?

Anyone else smell a lawsuit?
(1 reply) #32 HeartsOfWar on 15 Apr 2009 - 15:05
I don't think she's blowing it out of proportion. There are many issues with this situation:

1. Her 6 year old son was put into a situation that she obviously did not agree with and was helpless to "protect" against.

2. She purchased a new PSP, but it may not have been new.

2a. If it was a Walmart issue, they need tighter policies on checking merchandise upon return and instead of putting them back on the shelf, they should be labeled as "clearance" items.

People should not be paying full retail price for something that has already left the store. Would you want / expect to pay full retail for a vehicle that was previously sold? I won't...

2b. If it was a Sony issue, they need tighter policies regarding equipment inspection and testing coming off the assembly line.

Accidents do happen, but the nature of it being an accident doesn't negate the responsibility of the party at fault. The child should get a brand new PSP in exchange for the old one / memory card, but since he likely wasn't traumatized over the incident, that's all he should get.
#32.1 DSLJay on 15 Apr 2009 - 18:43
I agree, she is not blowing it out of proportion. She is a parent. I think she is doing the right thing.
#33 jthomas5150 on 15 Apr 2009 - 15:30
Come on, let's face it. People have to see a naked person sooner or later. Why not be six years old?
#34 Magallanes on 15 Apr 2009 - 16:57

Two words for you: Public Washroom.
#36 necroxd on 15 Apr 2009 - 21:41
This has happened before to wlmart. A few month's back it was with an Ipod and a 5yr old girl got stuck watching S&M. They don't bother checking their returns.
#37 Joshie on 15 Apr 2009 - 22:18
I think people are ignoring the most suspicious part of the article: the lady is demanding a new PSP to replace the one she bought.

Why would she need a whole new PSP? She clearly understands the memory card had the porn on it. She doesn't want a free extra game, just an exchange? Isn't that kind of sketchy? Why do I get the feeling someone dropped their PSP or damaged the screen right before finding this magic porn?
#38 coth on 16 Apr 2009 - 00:34
nude photo is not porn...
#39 Master Shake on 16 Apr 2009 - 04:54
