Web Site Sues Annoying Pest Troll

"A local pest-control Web site is trying to exterminate what it believes is a specimen of one of the Internet's most bothersome creatures: The Message Board Troll. GIE Media, a Cleveland company that runs the online pest-control portal PCT Online, is suing an Arkansas man who the company says is constantly leaving obnoxious and offensive messages on its Internet bulletin board and then, after he is banned from the site, sneaking back using fake names.

While the Internet has allowed the world to communicate, many public message boards are plagued by users - often referred to as trolls - who spew personal attacks, emit racist invectives or yell an online version of "fire" in a crowded theater. Many companies ban users, delete posts and even change locations to avoid abusive users. But GIE's suit against Ronald Huckaby in U.S. District Court is one of the more extreme attempts yet to control chatter on Internet forums.

GIE is alleging trespassing, breach of contract and violations of the Computer Fraud and Abuse Act. It is seeking at least $5,000 from Huckaby. The company also wants the judge to bar him from visiting PCT Online. "

How is it fair that the RIAA can impose restrictions on the majority when in reality on the minority are doing the damage? They fob of the public with the appalling notion that On-line Piracy is contributing to their loss in profits- its not! People are buying less albums etc mainly because of the economic down-turn - but equally- id say in many genres people are buying more- In the UK at-least Pop is going from strength to strength -especially from the likes of "Pop-stars".

The RIAA clearly here concedes the fact that it is unable to beat or stop file swappers; so its going to hit everyone.

I think this is a good thing however who judge's how bad a person is before they file the law suit? If I posted a message which could be classified as "trolling" when I had a bad day would that be grounds for Neobond or any other admin here at NeoWin to take me to court? This person sounds like he has caused a lot of problems for the website and probably deserves what he gets. I guess it is one of those who writes the rules and who polices the police kind of things. However I hope this will put some trolls off posting.

There is a difference between 2-3 'troll' posts and constant 24/7 trolling of the annoyingst sort. Then again, what do you think a pest-control site would do? Get rid of the pest (trolls...)

There's a "troll" on a different forum I go to. Does the same thing too! (Come back with fake names, etc.) Two things though, comes back rarely (only comes back when his member-flaming website is updated) and the person wasn't sued like this.

yeh i think peeps are missing the point. He's not just flaming, he repeatedly signing up after being banned, just to troll. I think it would be classed as harassment?

He does deserve it - If someone is being that annoying over that long of a time, and you did have a license agreement on your forum forbidding that kinda thing, kick the fool with a court order!

he deserves banning, and his IP range banned, and public notice given of his name, and a cease and desist order, and a bill for the service fee of the lawyer required, and sued, and arrested for public nuisance, and an ongoing tedious harassment by legal means .. far as *I* am concerned. just one mans opinion..civility is not possible to impose by legislation and fiat, as there are more idjits than nice folks with that sort of dedicated free time, however 'deserves' = similiar and equitable treatment. Abusers deserve* abuse. shame more of em don't get it.

This would be a good precedent for site operators but in a broader sense, it's just imposing yet another restriction on the "Free, uncensored speech on the internet" idea.

That's all it is: an idea. Speech isn't completely free and uncensored in real life, so I don't know why it would be on the Internet.
