Camera maker Eastman Kodak has launched a federal lawsuit against Sony, saying its rival's digital cameras and camcorders infringe on Kodak patents.

The suit, which seeks unspecified damages and an injunction barring further infringement, was filed late on Monday in U.S. District Court in Rochester, N.Y., according to Kodak spokesman Gerard Meuchner. Meuchner said the suit alleges that various Sony products infringe on 10 Kodak technology patents that were issued between 1987 and 2003.

A Sony representative declined to comment. It appears Kodak may have more than just Sony in its crosshairs. Meuchner said the camera maker is interested in licensing its technology to companies that may be using its intellectual property, but declined to name those manufacturers or say whether it is in discussions with them. "We cannot discuss talks we may or may not be having with others," Meuchner said, adding that he also cannot speculate on whether more suits may be in the offing.

So er... where was Kodak 5 years ago when other camera companies were selling digital cameras? Doesn't their waiting for the tech to catch on to sue, invalidate their case?

#3.1 OrangeSoul on 09 Mar 2004 - 21:57
if thats the case, kodak wouldnt be foolish to file a suit, the filed it for a reason. first read the complete infringment suit then make a remark

Actually, if they DID wait until it was widely adopted just so they could obtain royalties, I think something called "Failure to protect a patent" might come into play. IANAL, but I believe you have to let companies know when they start releasing a product for which you hold a patent. Deliberately not doing so, for the purpose of reaping royalties later, is not legit.

IANAL either but "Failure to protect" only applies to TRADEMARKS (like Windows(tm)) not PATENTS. Patents you can just sit on and wait until the best time to bite - which is why many people have issues with patents!

If Sony did something wrong, they shall deserve to be sued. On the other hand, I never buy Sony product as it is inferior in many diffrent ways. Ever wonder why it has such short warranty for their products? go figure.

Sony products are one of the best Quality, we have a sony tv for 15 years and its working....
#5.3 Chicane-UK on 10 Mar 2004 - 08:39
Agreed.

Sony might not be very good in the eyes of purists ("Oh, my 37 speaker surround sound Bang & Olufson sound system is VASTLY superior" - yeah, no **** brainiac) but they make damn good products.

I've had a few Sony items now, and I know a few friends who have too and they just work so well and last forever - like a friend who still had an original (the first type released) Sony CD walkman.. Sony TV's, their MiniDisc players.. they are just rock solid and how all electronics should be.

They have a short warranty because THEY KNOW THEIR PRODUCTS ARE DURABLE AND WILL LAST A LOT LONGER.

Sony'd products aren't that bad... especially compared with many of their competitors... the only thing you can fault them on is their price... you're paying BIG $$$ just for the sony name itself!

What? They are not suing Microsoft???
#6.1 grimreaper on 10 Mar 2004 - 03:05
hey sony is huge company too u know.

You know what, im going to patent the process of suing another company over a patent issue, a long while after the patent is originally violated.

Seems like every freaking company/organization is doing this these days. Company A supposedly violates companie B's patent, so compay B waits several years to make way more money on royalties from company A.

This is at least the 4th late lawsuit like this i've seen in the last year or so.
#7.1 qoa on 10 Mar 2004 - 20:13
I already have a patent on this, and look forward to seeing you in court.

Oh hilarious!

So Kodak start to lose out in the market because they thought it best not to fully embrace the digital world, and then when that industry takes off around them they throw their teddy bear out of the pram.

Losers, total losers.
#8.1 chris_kabuki on 10 Mar 2004 - 14:39
losers? They own the patents to that stuff... how can they possibly be losers?

Microsoft didn't embrace the internet at first... are they losers too? (Well in the unsuccessful way!!) No I think they did alright. You underestimate Kodak and the sheer number of patents and creations that it has under it's belt. They may a lot of money by licensing those out to companies... if Sony doesn't want to pay for them... they will now via this law suit!

Kodak's suit against Sony was filed after three years of negotiations failed to produce an accord

It's not like this popped up overnight in the back room of their corporate office. The patents in question were filed anywhere from last year to FIFTEEN YEARS ago, 1989. Kodak had previously relied on their superior film for revenues, and over the last five years have restructured to meet the changing market - Kodak is one of the earliest companies AFAIK to develop digital SLR cameras in the 15MP range. They obviously had plans and invested in digital R&D and now can claim what is rightfully theirs.

Stop spouting off about things you don't know anything about. A cursory glance at an article doesn't count.

#10 nathanintu on 10 Mar 2004 - 13:25
I THOUGHT I herd on the finance news on TV that Kodak has brought this on because there profit for last year was lower then expected.

Gotta get there money back some how!
