Microsoft employee sues Kazaa

There's a new legal battle over Kazaa -- and this time it has nothing to do with swapping copyrighted music online.

A native of Romania is filing suit and he claims that he wrote the source code to the popular file-sharing software. In addition to seeking the rights to the software, Fabian Toader is seeking $25 million dollars in compensation. Toader claims he wrote the computer code for Kazaa in 2000 while working in Romania on a freelance basis for Kazaa. The company then sold the rights to the software in 2002 to Sharman Networks. Toader claims he never signed a contract with Kazaa and, under U.S. and Romanian copyright laws, he is the owner of the program, not Sharman Networks. A spokesman for Sharman says the lawsuit is little more than what he calls "Toader's most recent shakedown effort."

got to be kidding. well probably a good tactic to sit back and wait till the company becomes huge then hit'em with a suit. LOL

4 years ain't that long in legal years lol. who knows how many papers he had to go through to get this far. either way i don't care as long as kazaa stays up and running

....Microsoft is funding this lawsuit. This way this dude with the 25 mill and Kazaa (also used to pirate M$ Software) gets shut down.

kazaa is probably the last place i'd look to get any pirated software. hello newb.

Hmmm, most states have a statute of limitations for things like this. I don't know California's particular law, but in Toader's current home state, it could have been as little as three years, or as long as six, so I'll assume that California isn't too much different.

What is interesting is the following line of language, which I have found to be prevalent in most state laws: ".... from the time that the plaintiff knew or should have known". If I were the defendant, I'd argue that he should have known a whole lot sooner than four years that he might have a case against Kazaa.

And I don't for a minute believe that in the four interveing years, he just couldn't find a lawyer who would take the case, if it had merit to begin with.

Ash may have a better point than we want to admit. I'd like to know who's funding Toader's legal expenses.

what a herk, everybody knows the kazaa engine was programmed by 2 Estonian guys who sold the software then to sharman networks for a pitiful amount on money, if anyone can remember theres was a huge story about this @ online newssites about a year ago

isn't he risking anything? if shareman is forced to shutdown kazaa and pay huge ammounts of money, and if he won the suit againt them, he'll have to pay..... he'd better not say anything.

While I was in a hunting expedition in Africa with Allan Quatermain and Han Solo, I needed something to smuggle my cargo past the Imperials. Soon Morpheus and Neo contacted me to use it in the Matrix, but it was already being used by another company. I have never told this story, because Captian Picard told me if I did, I would be punished and beaten by Warf. What a stupid f@@k, go home and realize your story is evern more BS than mine.
