Microsoft ordered to pay Lindows' court fees

An Amsterdam court has ruled against Microsoft in its attempt to obtain an injunction against Lindows, a maker of Linux software, as the two companies' trademark dispute continues.

Microsoft has alleged that Lindows' name infringes on its Windows trademark, while Lindows says that "windows" is a generic computing term. Lindows is also the name of the company's operating system software, though the company is now selling the product under the name Linspire in some markets, including Belgium, the Netherlands and Luxembourg, which are all under the Amsterdam court's jurisdiction.

Even so, Microsoft had sought an injunction to keep the company from selling its products. The software giant had objected to the appearance of the word "Lindows" on the company's Web site, technical manuals and other places. Microsoft had also asked the court to levy fines of more than $100,000 per day against Lindows. But Thursday, a judge in the Amsterdam District Court denied Microsoft's request for an injunction and ordered the software giant to pay roughly $1,160 in legal fees related to the litigation.

    I like the fact that a small company opposes Microsoft though it's sad that Lindow sitself is not a very good OS.

    Isn't Amsterdam where smoking pot is legal? If it isn't, the judge should be arrested. An absolutely stupid ruling.

    No, the only absolutely stupid thing is that Micro$oft doesn't know when to quit. They have already forced a name change on the product. MS needs to "cut their losses" and go whiz on someone else. I don't like the Lin-<name of the week> OS myself, but I don't like the way M$ is handling it even more. I commend the court system over there for a good ruling!

    I went to Walgreens (A drug store for those of you who don't know) andI was looking at allergy medication. I saw Claritin (brand name) and right next to it, their generic and cheaper stuff, Wal-itin.

    I don't see Walgreens being sued by Sherling-Plough...

    Hmm...

    I don't hate Lindows...pretty much ambivilant.

    However, M$ wanting $100k a day, vs judge giving Lindows $1k to cover legal fees...

    Seems there should be some way to punish people for filing frivilous lawsuits...

    Like making M$ pay Lindows what they wanted paid or something...

    MS sucks. They infringe all the time on more than just trademarks, yet when you violate them, they go after you like a shark on a lamb's buttocks. Hypocrisy!
