Microsoft wins $4 million spam verdict

Thursday Microsoft won a $3.95 million verdict against a California spammer. The Californian known as Daniel Khoshnood was ordered to pay by the U.S. District Court. Looks like Microsoft is making some good progress with its war with spammers.

Microsoft Corp. said on Thursday that it won an almost US$4 million verdict against a California man for trademark infringement, false advertising and "cybersquatting" stemming from an unsolicited commercial (spam) e-mail campaign to distribute a desktop toolbar program on recipients' Windows desktops.

Daniel Khoshnood of Canoga Park, Calif., was ordered to pay $3.95 million after the U.S. District Court for the Central District of California found in favor of Microsoft in the civil case, which Microsoft filed in June 2003, after receiving a flood of spam on its MSN and MSN Hotmail e-mail services from Khoshnood. The e-mail messages claimed to offer a toolbar that, once installed, would automatically update recipients' Windows systems with security patches, Microsoft said in a statement.

Microsoft won a summary judgement against Khoshnood and his companies, Pointcom Inc. and Joshuathan Investments, in January. That judgement ordered Khoshnood to stop using Microsoft's trademarks and name, refrain from spamming, and pay damages to and legal fees for the Redmond, Washington software company, according to a court document.

Fixed (Decoder):

A crash occurring in some rare cases with clips that have dimensions divisible only by 2 and use YUY2 color mode
Black screen when decoding old buggy MPEG-4 clips that lack VOL header
Internal flush operation with "Smooth playback" feature
Intra inverse quantization (type 1)
Support for generic MPEG-4 (XVID and 3ivX)
Data partitioning clip
Deblocking to no longer cause solid blocks to appear during playback
DivX decoder to always play DivX video

He owns an investment company, and that probably has a fair chunk of change. Either way, if he doesn't have it, his wages will be garnished for the rest of his life. He deserves it.

I do beleive that they are one step above the ass wipes that actually buy or use things that are advertised in the spam.

Now if we could just get those stupid Enzyte (and the like) commercials off of the TV, the world would be a better place.

BTW, just a comment to j.reed in post #6.1. There is a difference between ignorant computer users and stupid computer users. Ingnorant users can be taught and will learn through trial and error like the rest of us. Stupid users will never learn and will always cause problems for the rest of us. In my observation, people who fall into marketing scams (like spam campaigns) are generally ignorant, not stupid.

In other news spammers decided to go over seas to escape persacution and still make a crap load of money... sadly there needs to be a world wide law against spamming but I know that can't happen. At least we have one victory over the spammers.

I think this is the best, but slowest way to go about the spamming problem. If large corporations can spend some of their money taking down the largest spammers, things are bound to get better. And if they run overseas, just post their name and picture on the web, and I am sure every decent person with an email account will get in line to give the spammers behind a good spanking.

A Microsoft rep quoted to us last week that 95% of ALL hotmail was SPAM. Internally, 75% of Microsoft mail (employees mail) is SPAM
