Apple Fails to Patent iPod Interface

A near three-year-long attempt by Apple Computer to patent the menu-based software interface of its popular iPod digital music player has ultimately proved unsuccessful, AppleInsider has discovered.

The company's patent application, which lists Apple vice president Jeff Robbin and Apple chief executive Steve Jobs as two of its primary inventors, received a final rejection last month from the United States Patent and Trademark Office.

Standing in Apple's way appears to be a prior filing by inventor John Platt, who submitted a patent application for a similar software design for a portable device in May of 2002 -- just five months before Robbin submitted his claims on behalf of Apple.

He also used to work at the company that did the click wheel for Apple so it looks like he decided to steal some IP when he left the company.

This patent of his was filed about a year after the iPod was introduced and it was rejected a number of times. I seriously cannot understand how the guy got away with it.

lets not forget apple has a patent on the scroll wheel, which is far more unique than a "menu driven interface" I'm suprised there is even a patent for that because of "prior art"...

The scroll wheel isn't actually unique, it's been used in DVD's and such for a long time. as well as car stereos.
the only difference is Apple made their scroll wheel from a touchpad. that doesn't make it unique.

The "scroll wheel" is nothing more than a glorified jog/shuttle wheel that's been used as far back as VCRs (maybe further, I'm not familiar with the complete history of it but know that I have a 15 yr old vcr with such a device on it's remote). Yes it's neat, but it's certainly not new, especially when you think of it as really no more than a standard knob or dial that just looks a bit different.

but apple has a patent on using a scroll wheel with their menu system on a portable music device. It being a touchpad is an extremely useful thing! I can have my iPod in my pocket without the hold on, and not have to worry about the volume shifting because of it rubbing against my pocket lining. It only scrolls when I touch it. Any other design would cause a lot of irritation with me and may make me not want to buy it.

So the fact that Apple has that idea patented is really good for them. A lot of new things come from old ideas every day. It is the fact that Apple has an extremely good and rather unique implementation of the idea that gives them the edge.

well apple didn't make that menu style by any means! Creative was here before apple was with a menu that looks similar and had mp3 players before apple, but i still dont think creative was the first in the mp3 market...

The first on the American market was actually the Eiger Labs MPMan F10. The Rio was just the first one that really took off.

How stupid - it's a damn menu, it's not a big deal. It's sad how some people will do anything for money.
