Apple Sued Over Hearing Loss Claims

A Louisiana man has sued Apple claiming that iPods can produce sounds of more than 115 decibels, a volume that can damage the hearing of a person exposed to the sound for more than 28 seconds per day. Mr Patterson wants his lawsuit certified as a class action and is seeking unspecified damages and upgrades he says would make the iPod safer.

Mr Patterson’s lawyer, Steve Berman said he did not know if his clients hearing had been damaged by the iPod, saying “He’s bought a product which is not safe to use as currently sold on the market.”

Apple have declined to comment on the allegations, but do include a warning with each iPod saying “permanent hearing loss may occur if earphones or headphones are used at high volume“.

just dumb.

if you listen to anything too loud and too long you'll damage your hearing, it's just dumb,

i have always listened to stuff at a low rating, not because i'm scared, just because i don't like things loud, personal preference.

look at it this way, going to a rock concert and standing in the front row is all very well now and then but moving your desk there and working 9-5 in front of it is just gonna do you harm, and whack out your heart and nerves.

it's like sueing a burger king for making you fat, hey they didn't force you at gun-point to buy that big mac.

thats crazy... do we sue car manufacturers for makeing cars that people can CHOOSE!!! to speed and kill themself in?

And people can go deaf for various other reasons that don't include a disclaimer(which Apple did). I hope the judge throws this out. If you don't have the sense to realize that loud things can cause hearing damage... well, I don't know what to say. How does one go about daily life without having that kind of sense?

dang it...now the next generation of iPods won't get as loud. For us people who already have hearing problems, the iPod won't be loud enough in the future to be useful.

They have a disclaimer on their product. Many portable music playing products will damage your hearing if you turn it up to max. This is a just another stupid class action law suit.

What a fool. I think Im gonna sue the makers of Chuncky Chilli since it gave me diarrhea after I ate 4 cans!!!!

They already include the warning which is good enough. This guy is going to lose because of the warning that is included with the ipod. Their is no law in the US which states that portable devices have to be a certian db. I don't thinik that this guy will win.

Why now? Why Apple and the iPod, why not since 1985 with the Sony Walkman? It could allways be too loud.

What about kids in they cars with blasting music? Cars that move by themself just because of the loud bass.

This is getting crazy. Need cash? Don't want to work? SUE!

The volume is at the discretion of the person that listens to it. This idiot Louisiana man shouldn't have to worry about it.

I'm thinking about the possibility of suing you for extreme mental duress after reading your post. Spelling errors and lawsuits aside, I really doubt you need democracy. Maybe what you want is s justice system that allows for personal accountability.

Yeah and thats why I stuck the link in there, if I am pointing out the fact and showing where it was already posted is not just an "old news" post especially since if you had say made a thread about this topic in the forums it would have been closed since it was already posted in a thread....happens all the time take the new µTorrent build as an example.... as for people not reading it there are over 100 replies...almost 10 times more than are in here... :whistle: so I am guessing someone is reading it

I really hope they don't change the max volume. I have a set of speakers that can't go very loud and have no volume knob (came with an old HP), and I use them for my iPod mini, but I'm running out of space on that, so I'll need an actual iPod soon. If Apple decides to put a volume limit on it, I won't be able to sue those speakers for my iPod anymore; it won't be nearly loud enough.
