RIAA Sues Family Without Computer or Internet

So, you don’t own a computer and don’t have internet access. Why should you care who or what the RIAA (Recording Industry Association of America) is? After reading this, you may think twice about that.

In the RIAA’s latest lawsuit extravaganza, they have managed to sue a family with no computer and no internet access. Carma Walls is the latest victim of the RIAA who’s subpoena states:

"Plaintiffs are informed and believe that Defendant, without the permission or consent of Plaintiffs, has used, and continues to use, an online media distribution system to download the copyrighted recordings, to distribute the copyrighted recordings to the public, and/or to make the copyrighted recordings available for distribution to others'."

What’s interesting here is that the subpoena says "has used, and continues to use." However, as stated before the Walls don’t even own a computer or have any internet access. Are you really surprised? How can they “continue to use” something they do not have (and have never had) in their possession.

Walls also stated that his family has lived at their current address less than a year. The prior occupants could have had a computer and internet access. The prior family could also be the at fault party. However, the RIAA is refusing to even consider this a possibility and insists that Carma Walls infringed eight copyrights.

Ill restrain myself from saying any naughty no noes over this, but it was hard. This really is pathetic really, if the completely innocent are getting sued makes you wonder, why not? If your gunna get sued whether or not you download copyrighted stuff or not, might aswell get some lovely new media for the $2000 or whatever is your gunna have to pay...

so you are saying its not old news for you because you didnt know about it? is like saying someone 20 years older than you is not 20 years older than you because you didnt know he/she was 20 years older than you.

Now you are compairing apples and oranges.

I'm simply saying that "old news" is relative to the reader. What's old to some, is not old to all. Judging by the majority of the comments in this article, there where a lot of people who don't consider this "old news" and are here reading it for the first time.

The sad part is that the lawsuit isn't even the worst... I guess the worst is that they'll probably have to settle out of court anyway because the persons here don't have the legal force to challenge RIAA anyway.

your probably right ... it's a damn shame when companys abuse there power and they know they can pretty much get away with it... but can that family fight them and if they win (which they damn sure better win) get compensated for all the fees they had to pay while being sued? ... i think they should because if not it's WAY to easy for a big company to bully any average joe they wish with impunity!

its the same thing, this article has been on the internet for some time already (weeks) so in a way you could say that this article is "X weeks old", the fact that you didnt know it already existed doesnt make new, it makes it new for you and the people that didnt know about it but it already has a date of being "born"

It's a moot point. The fact of the matter is that the article was posted here today. Not everyone has already heard about it. If you wish to have more recent news feel free to use the news submission page available here on Neowin. If you choose not to use it, you have no right to complain. This is a useless case. If the judge was smart, he or she will just throw it out of court. This would be like charging Martha Stewart for the O.J Simpson case.

i already have... i have been going to neowin less and less and they have gotten crappier and crappier... i don't look at neowin as a news source anymore... the forums however are solid - it's the only reason I come to the site anymore. It sucks though because neowin used to be on top with their news... now it is a joke sometimes how long it takes for them to post stuff up... after a certain point just don't post it! the saying "better late than never" shouldn't apply to a tech news headline site.

Far be it from me to jump in on the ever tiring "old news" brigade's fun, but it's only old news if you've already it. I, and no doubt, countless others, hadn't, that makes it new news. Jees, there must be better things to bitch about than how old news is, surely?

Back to the RIAA. Not being American, surely your courts see through these ridiculous lawsuits, don't they?

The RIAA is a joke, everybody should boycott any and all media that the RIAA controls, bring the record industry to a standstill STOP BUYING MUSIC AND/CD's in the USA.

This would put an end to the RIAA.

and send a message to all recording artists, that the public will no longer be threatened by the RIAA, and if you stand with the RIAA and it's bullying of innocent people then your career is toast !

nuff said, It's the people who have control to do something about the RIAA, STOP buying music !

I thought the point of this article was that these people hadn't done a single thing wrong, and yet the RIAA was still on their case?

The way I see it, there's no way out of this now. One could say that the RIAA are only doing this because not enough people are scared. I mean heck, what's scarier than getting in to trouble for something you haven't even done? Especially with the levels of money the RIAA seems to charge people for, this kind of thing could destroy a family. Considering they did nothing wrong, that's pretty harsh.

if they are truely innocent and don't own a computer or have internet access, then plenty of lawyers will be giving them calls to defend them and also counter sue the RIAA for large amount of money.
