Man sues online florist for revealing affair

An online florist is facing a million-dollar legal case after it revealed one of its customers was sending flowers to his girlfriend.

Leroy Greer is suing 1-800-Flowers after it sent a thank you card for using its service to the man's home address. His wife opened the card and queried the order, which was then faxed through to her.

The fax contained details of the order and the message "Just wanted to say I love you and you mean the world to me! Leroy". The order also included a stuffed animal.

Greer's wife amended the fax, sent it to her husband and has sued for divorce. He is now suing the florist for a million dollars in the Texas Southern District Court.

Usually when you order something online you have to "opt out" of the company or its 3rd party affiliates sending you mail.

I think he will lose his case based on that and basically he got owned.

He didn't get owned because of the letter, he got owned because they sent a fax to his wife on request with details about the order.

actually he got owned for cheating and too stupid to realize he left a paper trail....and will get owned again in Divorce Court.

I think if he wanted to play around then he should have terminated his marriage first. I have no sympathy for people that cheat in relationships. He deserves everything he gets.

May be the fax contain a custom linux OS, and linux is a enemy of Windows... and Windows is mentioned in neowin, so this news is 3 step ahead of neowin.

wow, there's no way this can win. as if the florists knew he was using their service to cheat on a spouse. what they did is called good business in the rest of the world, you thank your clients. we're pretty much expected to send hand written thank you notes at my work place. it is funny though, while I'm making a lot of assumptions here, it sounds like she's as bad as he is, two rotten eggs well deserving of each other.

Whilst he can't do squat about the thank you card, it's a whole different story with them faxing details of an order to his wife. They broke all kinds of data protection laws doing that, so he could quite easily win.

Of course, if he does.. half goes to his wife... :p

I have to agree with you. My mother can't even get details on her phone account unless my father gives the person on the phone the "ok" since it's in his name. It's because of jerks like this that things are complicated in the business world. He is part of the reason why the world sucks. Keep your penis to your wife!

Sorry buddy it's not the florist's fault you cheated. Now your new girlfriend will see how much of a loser you are as she watches you lose your wife, your lawsuit, and any shred of dignity you had left.

Sure it's his own damn fault but I'm also sick of companies using personal transaction information for their spamming purposes.

Is it so wrong to want to order something without the company thinking that it's a license to flood your mailbox/inbox with BS?

What's this got to do with spamming? From what I understand, they sent the thank you card to the billing address (not shipping) and his wife wanted to know where the gift was sent hence why they faxed her.

It was unsolicited mail and therefore spam/junk.

I don't care if it's a box of yummy cookies from the flower shop manager's mother...if it's using personal information to send people unsolicited BS then it's spam.

It isnt illegal to cheat on a spouse, but it is illegal to pretend to be someone else to get account information. Did she pretend to be him to obtain the details via fax/email? Or did she just call up and ask over the phone?

Had to dig through to the real article hosted on another site, http://www.abovethelaw.com/2007/08/greer_v...s_an_update.php . This suggests the marriage was already over, and the wife used this escapade to seek an imbalance of marital wealth in the settlement. So theyre already getting divorced? Was it his fault, her fault? Did he cheat because she did? Did they proceed to divorce because he has a history of this crap?

She may not have pretended to be him. It's pretty hard to say that you are a man, when you most likely don't sound like one. To obtain information from companies like this, it's actually pretty easy, if you have the right information. Like the billing address, the credit card info, social security number of the person, order number, etc. Plus being his wife, she probably had a very easy time getting the information sent to her.

This guy is just a loser and should have waited until their divorce was final, or legal separation was in place.

Data protection laws are crazy and nonsense, who knows who will win? I wouldn't put money on which way it would go.

My contact lenses are paid by direct debit by someone else, and yet... they can't ring up and talk about my order to the company, even if they wish to talk about the payment of them. I have to give permission to the company that the direct debit payee can talk about the direct debit payment!?!?!
