Apparently not content after losing legal battles with both Amazon's A9 and Google, soft-core porn site Perfect 10 filed last Tuesday in a California district court against Microsoft's MSN search engine, alleging that the engine is providing links and images to sites that are illegally hosting its content. Perfect 10 claims that the MSN image search engine creates unauthorised thumbnails of Perfect 10's premium content, as well as including links to see full-size versions of the images for free. In addition, the site also claims that the search engine is finding passwords to its paid-for content on other sites, thereby allowing it to access Perfect 10's pay-only material, and that Microsoft is receiving money through advertising from websites that are illegally hosting the images.
"Microsoft has rejected efforts to reach a settlement and our business is being destroyed," said Norm Zada, president of Perfect 10. Zada claims the search engines are responsible as they make it easy for surfers to find infringing content, and is costing the company $4m a month. Although earlier it looked like Perfect 10 might win its case against Google and Amazon after a judge ruled that the two companies could be partially liable for infringement for displaying the thumbnails, the decision was struck down by a judge for the Ninth Circuit Court of Appeals, who cited "fair-use" principles and pointed out that the full-sized images were not hosted by the search engines. Perfect 10 is appealing the court overruling, but as yet no court date has been set.

At one time CyberErotica.com was paying out over 5 million a month in just referral fees. VoyeurDorm was featured on a CNN as one of the top grossing adult websites on the internet at 15.8 million/month, and that was a few years ago.
The Adult Entertainment industry is HUGE money. 12.6 BILLION in 2005, 16 BILLION last year, and surely 25-30% more this year. It is an ever growing business, and like they say... Sex sells.

Err, I never actually said I didn't believe they have a profit of over 4 million. I said I didn't believe they were losing 4 million dollars due to Microsoft search images. Quite different.
If you can estimate the number of hacked free accounts, the bandwidth used displaying images and other content by not securing their site, and the cost of manpower to actually track all their whining, 4 million is cheap.
I did a rough search on 5 search engines and there was enough content from Perfect 10 alone to make yourself a profitable adult site, let alone the other 500,000 websites who's images and content are readily displayed via image search.
Now do I think this is the search engines fault? Hell no. Secure your site, turn on hot-linking, do something for the love of god. Just don't whine when your content is all over the internet because of your own faulty actions.

Maybe I should sue Google, MS, et all for listening to the 10 characters in my robots.txt and not indexing my site and giving me free advertizing.
