Microsoft, IBM Sued over Patent Infringement

JuxtaComm alleges that its data integration patents are being infringed by companies that include Microsoft and IBM.

Data integration software vendor JuxtaComm Technologies has filed suit in a Texas court alleging patent infringement. The case names a number of high-profile software companies, including Microsoft and IBM.

JuxtaComm is alleging that the companies in question—which include a number of prominent business intelligence and application integration companies—have infringed its patent for a system that transforms and exchanges data between distributed heterogeneous computer systems.

JuxtaComm originally applied for the patent, filed as US Patent 6195662 B1, in June 1997. The patent license was granted in 2001.

Because for a period of time, a particular court in Texas was known to be a pushover for these sort of patent suits, making it easier to entrench yourself legally.

1. Get weak patent
2. Sue in friendly court to establish a legal footing
3. Profit!

Well looks like there a Canada based company. And it looks like there talking about Shadow Copy from MS side of the fence or just Data Replacation in general. The patent makes almost no sence to me with made up words.

The US patent office is handing out patents way too easily "transforms and exchanges data between distributed heterogeneous computer systems", unless they actually define in what context they mean by transform and heterogeneous that basically describes any programs that transfers data directly to another computer.

I found the patent and it's on the parent company to Juxtacomm's website: http://www.teilhardtech.com/ Looks like the law firm is in Texas, and company is in Canada. Also appears that Oracle sued them last year to invalidate the patent and lost, so this little David is now going after the Goliaths.
