The French regulatory authority, called the Council of Sales, said Monday that eBay's French site should be held to the same standards as other auction houses in France -- which must acquire a special permit from authorities that includes guarantees of consumer protection.
In a statement, eBay's French branch, eBay.fr, said the suit was "totally unjust."
"eBay has invented a new way of buying and selling, which has been adopted by 10 million French people, and which is not at all the same as that of auction houses," it said. The Council of Sales, whose members are state-appointed, said it was not trying to crack down on online auctions, and that it encouraged them. But it said it had been studying eBay.fr carefully since 2003 and had compiled a long list of problems.
In one case, it said, a buyer who expected to purchase an 18th century painting actually received a piece of wood with a photocopy pasted onto it. Fakes are a big problem on eBay.fr, it said, especially with African or Chinese art. In other cases, sellers never send the object to the buyer, it said.

This happens everywhere, not just la France.
I know exactly what I'm talking about and your response completely confirms that in fact you don't. You like the gov wiping your ass over mundane everyday things such as this? Of course you do.
But with ebay you are technically running the auction... you can end it, cancel bids, all the stuff you can not do if you turn an item over to an auctioneer... with eBay you have a lot more control
Common sense and some caution go a long way. If it's really a problem, people wont use ebay or someone could start a new business that acts as an escrow agent. No need for government intervention.

our little story.
On 11/29/07 after we listed 2 very successful products on eBay from time period 10/28/2007 as user cooldeals2go and generated over 24,000.00 in sales for a four week period, PayPal, Inc., restricted access to our funds (which we cannot transfer $11,999.69 USD in funds to our bank account) and had eBay close/suspend our account cooldeals2go.
we were not selling any items that are illegal and our products were downloadable from the Internet and did not break any copyright violations AND WHERE self-made.
we did notify PayPal, Inc., by phone to prior to 11/15/2007 to to let them know to expect an increase in sales so they would be provided with what we were selling, we also own www.hostitplanet.com and www.hostitplanet.com and reconfirmed them about our sales for website hosting, we specifically told them to document it!. Therefore we felt we were clear with notifying them, also the restriction has caused eBay to suspend our account which means loosing an estimated amount of $3,000.00 in sales per day and the inability to send products to our customer totaling around $2,500.00. We have contacted PayPal,Inc. 9 times in a 4 day period from the time they restricted us, and supplied all requested information which we can verify we sent. and then they pulled the no appeal crap.
we can prove via screen shot to the items we submitted we have also some disputes from October that PayPal, Inc., has neglected to deal with for over a month.
oops they finally did, but they has not started on Novembers!
Now if anyone has an invite for us to get some help that would be great!!, because we did nothing wrong with any policy. and PayPal requested a credit check without our permission!, we are looking also for information on starting a class action lawsuit on paypal/ebay/ and forcing users to use un FDIC paypal. thats just uncalled for!
