Teen Arrested For Posting Nude Pictures Of Ex On Myspace

MAY 21--Meet Alex Phillips. The Wisconsin teenager is facing felony child pornography charges for allegedly posting naked photos of his 16-year-old ex-girlfriend on his MySpace page.

When contacted by police about the two images, Phillips, 17, balked at removing the pictures of the girl. Warned that he could face jail for publishing images of the minor, Phillips told an investigator, "F*** that, I am keeping them up," according to a criminal complaint filed yesterday in Lacrosse County Circuit Court. Phillips told cops that he posted the photos last week "because he was venting." The cell phone camera photos had been taken by the girl, who provided them to Phillips.

Along with posting the photos, Phillips added explicit captions like, "Yo, U see how big her hole is! Its from me!" While claiming that his goal was not to harm the girl, Phillips acknowledged that, "he probably should not have done this," according to the May 20 court filing. Along with the child porn count, Phillips was charged with defamation and sexual exploitation of a child.

US has the dumbest justice system. If they arrested boy, she has to be arrested too...equally guilty. Btw, i would not arrested anybody, but fix our damn education.

There are cases where those woman are really abused by their husbands, bf. Judge etc should be more careful when they are having cases like that.

I'm from the UK & it seems to me they are both as bad as each other,but what are they really guilty of?,if they were bf & gf,old enough to have sex etc at the time why the whole getting arrested over a couple of nude pics?,sure I understand why you'd be p'd off if some nude pics of yours turned up on myspace & myspace dont allow nude pics in the 1st place,just seems stupid branding the whole thing as child porn,16 is young adult(or adult) in my books,defo not child.

Forgot to add why did the police ask the guy to take the pics off the Myspace site?,surely the police could have got myspace to remove them in the 1st place either by the report function or just the fact they are the police baring in mind myspace have rules about porn.

Well, if he didn't say stupid **** like "Yo, U see how big her hole is! Its from me!", I'd say let him go. Obviously that was intended to be hurtful. After all, if I was the girl and someone in school saw the pics and comments and told me, I'd be deeply hurt and embarrassed.

*sigh* Kids these days have no idea about how to get revenge (a.k.a. "vent"... The School of the Street really needs to reopen its doors and start admitting new students. Then they'll learn how to do things right, without getting caught. Seriously, all the kid needed was a bit of street smarts to think of a better way to get back at her.

I live 20 minutes from La Crosse, Wisconsin, and you'd be surprised by the stupidity of some high school kids around this part of Wisconsin. I wish I could say that this is just a single black eye on the face of Wisconsin, but I've met five separate people from Wisconsin who were 21+ years old and were dating 16 year olds or younger. I don't know if they think it's cool or something, or if it's some kind of f'd up trend, but I've seen it too many times to say this is an isolated case; this is just the most public case.

Also, they put a picture of this guy on the cover of our local newspaper (I didn't know they could do that since he isn't 18, but maybe that rule changes with sexual offenders? Please feel free to inform me if you know why they can do this...) and the guy did not look like a winner. He looked like the type of guy that would tell the police to **** off for telling him what to do with his myspace page. You can see his picture in the link in HenryC's comments.

Honestly, who has to defend their myspace like this? It's a website! It's like those old lycos, geocities, or homestead sites, just throw it away and start a new one ffs! DAMN! Also, good call to everyone who said this kid is getting raped in prison. He will.

Also @ HenryC, sorry man, La Crosse is a beautiful town, it really sucks that your hometown is getting this kind of negative national publicity. I feel for ya, I feel a bit embarrassed as well, and I only live near it, not in it.

And yes, the kids around here are total idiots. Was true 10 years ago when I was still in high school, and is still true now. Doesn't help that we've got 47 bars per square mile around here, either.

Take it most or all of the 16 year olds were used then?,as for those younger than 16 I dont agree with that at all.

This is actually a bit strange. I live in La Crosse. I went to school here after spending a few years at UW. While I think what he did was sick, I am not sure if 16 can properly translate into child porn (given that he was underage as well). To be honest though, I don't regularly check the state statutes on such matters because they don't concern me.

It is a nice area. I, however, do agree that there are way too many bars (river deaths and now this).

Take it you are replying to me,I'd understand if it someone over 18 taking pics of someone under 18 but that isnt the case here,from what I've read both the girl & guy knew what they were doing,just when they split things went too far.

What is the legal age of concent in La Crosse out of interest,did a search on Google but couldnt find anything,1 thing that bothers me is descrepencies between sex,porn(images or video) amongst other things in various places in the world,why cant things be the same age?,its stupid you can be classed as an adult/old enough for one thing but a minor/child for another.

Count 1: Possession of Child Pornography

A 17-year old with pictures of his naked 16-year old girlfriend that she took and sent to him. Application of the law outside of it's intended realm of protecting children from adult predators.

Count 2: Sexual Exploitation of a Child

Again, the girl took the pictures of herself with a camera phone and sent them to him. They should charge her with making child pornography of herself.

Count 3: Defamation

Seems as though he provided proof through evidence supported in the said photograph... "Yo, U see how big her hole is! Its from me!" Congratulations to the prosecutor for injecting themselves into a meaningless teen argument, it's probably a woman as these charges are obviously biased against the boyfriend.

The only thing the defendant is guilty of is being a dumbass. He should have taken the photo down when the cops requested him to do so. MySpace could have removed the photo and his account at anytime the police requested. Furthermore, I don't think it's proper to press three separate charges for a single incident (if you even define it as crime)... I'll give this my ridiculous news item of the week award.

This guys gets charged for child porn when it was his 16 year old girlfriend who voluntarily took the pictures herself and sent them to him and she's obviously sexually active with him, he shouldnt have posted them in public but he shouldnt go to jail for getting revenge on an ex.

If he loses in court I hope every single one of you who made comments about him (who is 17 and would also count as a child) getting anal raped in prison go to jail too because according to you being dumb is a crime so therefore yorue all guilty of it too.

Its the way the court system works. You charge someone for what you can, to get them for what they deserve. He posted, without permission, to be a rude, mean jerk nude photos of a girl on a public website, and then made derogatory comments about her. How do you prosecute that? By finding the most sever possible crime so that as it gets cut back and things like age come into play, he doesn't end up getting off with a slap on the wrists.

I'm not sure why the girl should get charged like everyone thinks. The problem was POSTING them on the internet.
It's the girl's fault for taking them, sure. But she took them herself.

Must be a humiliating experience for her, I'd imagine. I'm surprised MySpace didn't take them off themselves shortly after they were being posted. But, they can't look at every picture themselves until someone reports them, right.

Under the law, she should be prosecuted for producing the pictures, and he should be prosecuted for posting it. Personally, I think the law is stupid anyway, as in many places in the US (not Wisconsin however), it is perfectly legal for the two of them to have sex, but taking explicit photos of anyone under 18 is always illegal.

Are you serious? Someone said self-taken, child pornography pictures are a form of art? For God's sake I hope they were being purposefully ironic, but this is the internet so who knows. Come on, what the hell kind of argument is that when Annie Leibovitz, a professional photographer for a highly stylized "artistic" magazine, gets guff for taking non-nude pictures of a 15-year old girl? Remember that? It was last week or maybe the week before, featuring Miley Cyrus. Anyone remember that?

Seems like child porn is getting a lot of press lately, which will hopefully act as a deterrent to the idiots propagating it. But, this is a messed up world with very little justice and even fewer happy endings, so I'm sure the problem will spiral on through the gyre of time.
