"We have strong relationships with many of the state attorneys general," said Microsoft spokesman Jim Desler. "We work with them on various activities and initiatives. On this issue, we agree to disagree. While the states do have a role in antitrust enforcement, the non-settling states stepped outside the boundaries of that role when they chose to pursue a different course from the Justice Department, resulting in conflicting national competition policy."

In making the filing, the states are trying to protect their sovereignty over antitrust matters, something a dismissal could potentially undermine, said legal experts.

"There are a lot of us who, having done antitrust defense, would like to see this whole dual-sovereignty issue resolved," said Emmett Stanton, an antitrust lawyer with Fenwick & West in Palo Alto, Calif. "If there was a case to challenge this, this would be the one."

The "friends of court" briefs filed by the 25 states were not expected, but a third brief from the litigating states came as no surprise. The states rebutted Microsoft's request more in the context of the overall antitrust case than in regard to the sovereignty issue.

They argued that Microsoft's request is "effectively, a motion to set aside the Court of Appeals' mandate."

In June 2000, seven judges unanimously upheld eight separate antitrust violations against Microsoft.

The filings could give the litigating states important air cover as they return to court next week for what could be as much as eight weeks of testimony. They are looking for stiffer sanctions than those proposed by the Justice Department and the settling states. The settlement largely puts restrictions on Microsoft's business practices. The litigating states also want restrictions on how Microsoft develops and deploys software.

While overseeing the settlement proceeding, Kollar-Kotelly must weigh whether the settlement meets the standard demanded by the Nixon-era Tunney Act. That law requires that a settlement be in the public interest and that no backroom dealmaking influence the process. Kollar-Kotelly could reject or approve the proposed deal at any time.

No way. It is bloatware, and if you are running XP, then there is a very good chance it will wreck utter havoc with your system. Stick with the Burning Rom. Fast, reliable, and without the crap :rambo:

I couldn't, just couldn't leave it alone no matter how hard i tried. I thought I would succeed where no1 succeeded before to install it properly on XP. But this time I know for sure: Roxio NEVER again Nero rules.

I aggree with you on the auto update But I have to say I like Easy cd creator. I have never had any problems with it. It works perfectly on my PC and it is very User friendly. Nero burner is also a great program. =)

Wouldn't it be wiser to give the link to the update at Roxio's website. You only need to install this update, as oposed to the update and the Windows XP update separately. Thanks Roxio for taking about 4 months longer than expected for this update.

I have this installed fine on my XP system, no problems at all. If you follow the Compatibility Install instructions perfectly, you should have no trouble. I love this software and I am very happy with it.

Roxio sucks, Easy CD Creator sucks. Its huge, slow and painful. If you want software that will do something don't get EasyCD.. they have had problems way back since version 4 came along. Nero, CloneCD and/or DiscJuggler along with Virtual DAEMON will cure all your problems, and all 3 installed is still smaller than EasyCD creator deluxe.

It you are using Windows 95/98, and you use the backup/recovery system, that came with this product, THAT YOU PAID FOR...... DONT INSTALL THIS ..it REMOVES "Take Two from" your system ..I realize that they had some problems with systems that didn't run DOS, like XP but some folks bought the package because it had back up/recovery software, now they will "Update" it for you and remove the software... Kinda like finding out the radio you got in your new car won't play am, so you return it to the dealer for service and they take out the radio.......

You people are idiots. I have been running Creator 5 with XP on probably 10 different systems with no problems if you FOLLOW THE FREAKIN' DIRECTIONS!!!! This is not to imply that Creator 5 is in any way superior to Nero, shoot I still prefer CDRwin 4. T

Don't be daft! Nero 5.5.7.8 CAN make bootable cds. So far I've done XP and win2k .I'll give ya a hint...on the iso tab make sure all the settings under "relax iso restrictions" are unchecked...except the last 1, which adds that silly iso file version extension to mess up the works. No registry hacks for this version. Just simple common sense. :smart:
