Google as spyware?

How is counting the number of searches you've done spying? Tracking what you search for in a location they could get to, ie a cookie - then that would be spying.

Neowin is tracking the number of posts you have made - is that spying?

That is kinda my point, if they can track how many searches you do , then can they also track what it is you are searching for? Seems to me the answer would be yes, and that would definitely be spying.

hmmm... not as for the files, since I got a bunch of them that play at modifying my stuff so I send them info each time I open my web browser... and they are draining my ressources (and they are vital for my computer).

I guess it depends what you have on your computer. I personally wouldn't want my resumes, thoughts, documents, family photos, etc going to some company.. I mean hell last figure I heard is 1 in 4 North Americans are subject to identity theft at some point in their lives - and spyware makes it that much easier (not to mention it messes your computer up)..
