YellowAsprin1 Posted September 11, 2012 Share Posted September 11, 2012 I have been accused of something absolutely horrific that I can end up behind bars, get sued, etc. Without getting into it (which I plan not to) the reason I'm accused is because of a he said / she said type of thing. Because I ACTUALLY didn't do it, there's absolutely not evidence, so I don't have to worry about anything criminal. My biggest fear is that this is going to ruin my life, reputation and my families life. Even though I am "Innocent" I find it very hard for someone to be completely 100% sure... like there will always be that doubt... that's how rumors fly around, and not to mention how people love to gossip. I'm thinking about taking a poligraph to clear my name. I don't really know much about these other than the fact that I watch the murder shows on TV, but here are my concerns. 1) I've been readiing on several websites that these things are 90% to 95% accurate. So that extra 5-10%... is that of people who were truthful and the test said not truthful or the other way around? My life would be over, if this came back as a false positive. 2) Also, I know it measures your reaction when you answer the question. Now I have to admit that even though I didn't do it when I answer "the question" my heart beats a little faster, the hair on my skin stands up even so slightly. I'm afraid I'm doomed for this test Opinions? Thanks Being in this situation... you can't help but think of how stressful it is for people to be on a murder trial, that are innocent... and god for bid be falsely accused. It's not going to court, because as I didn't do it, there is absolutely ZERO evidence. It's not even close to going to court. Despite all evidence to the contrary, people love some 'drama' and they LOVE to gossip. It's VERY unfortunate. With these sorts of things, people end up moving to different states just to escape the constant rumour-mill. It's very sad, and I feel for you :( I don't think a polygraph would really help - only because it's evidence that YOU are providing someone who doesn't believe, thus they still won't believe it. theyarecomingforyou Posted September 12, 2012 Share Posted September 12, 2012 You don't need a polygraph to prove you're innocent - they need to have evidence to prove you're guilty. Polygraphs are not legally admissible in court and are easy to cheat, so I wouldn't put any stock in them. If you feel you have to get a polygraph (and I recommend that you don't) then you should get a reading done privately first - this will ensure that a) you pass, and b) you can challenge any contradictory result at a later date. Since they're so unreliable, they're given often by law enforcement, investigators, and employers as a scare tactic. They're not usually taken as evidence for or against you in legal proceedings. It COULD help your standing with an employer. Listen - the very fact that you're going on about polygraphs on neowin kind of suggests to me that your relationship with your lawyer is not good enough. If you're in a bad situation you need a good lawyer. If you're scared it sounds bad enough and talk to a trusted lawyer that you have some reference to. Lawyer lawyer lawyer lawyer. You need a lawyer. Even if it's just a workplace or school thing, the lawyer will easily guide you through the best path. Schools and companies have lawyers you can talk to. I was once accused of something... I was scared... It wasn't that bad, but with my (free) lawyer's help I was cleared and got just a black mark on my reputation (there's nothing you can do about that sometimes!). Some have gotten together to embellish the details. I stuck to just telling the truth but have come to trust people less because of the experiences. Over the years I've become less social. Selective on who I friend. No matter what you do people will say **** about you. You just gotta say "**** em" and move on. You say there's no proof, then stop worrying what people think. Unfortunately, in practice this doesn't always work like this. As such, I would recommend the same thing as most other repliers: seek legal advice and follow it. The only thing that can prove one way or the other is cold hard evidence, and Polys don't prove a thing. If you are put under the pump whatever you say during a Poly can still be twisted to be used AGAINST you so there is NO BENEFIT, only potential incrimination if you accidentally say something the wrong way. Also anything you say can limit your defense even if it is 100% truthful because not having any evidence by logic that you are innocent doesn't mean that it won't make it to court or that they can find some "evidence" that you in reality have nothing to do with but the judge is not to know that.
