KingCracker Posted January 8, 2014 Share Posted January 8, 2014 Two home invasion suspects are on the run and a third was fatally shot by a South Florida resident who fought back against the armed intruders with an AK-47 Thursday night, police said. The incident happened at a home on the 6100 block of Southwest 48th Street, Davie Police spokesman Capt. Dale Engle said. Three armed men entered the apartment and pistol-whipped the resident inside, police said. He then confronted the suspects. ?The resident of the apartment had possession of an AK-47 and after he received this beating he was able to get possession or control of that, and started shooting at these suspects as they were fleeing,? Engle said. He received significant injuries but was later released from a hospital, Engle said. The shooter was also taken in for questioning but has since been released. Lol most of my guns are made in other countries, I think the only gun I have that is made here is my AR-15, I don't care what country makes it, if it saves my life i'll gladly use it. This would absolutely classify as self-defence, unlike all those BS cases where people shot innocent strangers who'd just come knocking and asking for help and then claimed self-defence or anti-trespassing and got away with murder. I'm sorry, are you saying it's not a very accurate weapon? Over a distance I would agree with you, but close to medium range (where elevation is not a factor) they're very accurate, and the larger calibre bullet does devastating damage (Having said that, I'm going by the videos, and documentaries I've seen, and not actually fired one in real life so I'll give you that) One could conceive, if indeed they entered, and saw the Kalashnikov (assuming it belonged to their victim) they would probably had shot first, killing him, instead of beating, then took the weapon along with any other loot they could carry....? DocM Posted January 8, 2014 Share Posted January 8, 2014 Clarifying, Shooting a fleeing felon, which by the fact he's fleeing implies "in the back" or at least a quartering shot, falls under the Common Law's Fleeing Felon Rule (FFR.) Under the 1985 US Supreme Court Tennessee v. Garner decision police use of FFR "may not be used unless necessary to prevent the escape and the officer has probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others." In the 1990 Michigan Suprem Court People v. Couch decision it was held that Tennessee v. Garner, * was a civil rather than criminal action; * did not affect Michigan's Fleeing Felon Rule; * that a citizen may use deadly force when restraining a fleeing felon in a criminal matter. The last part basically augments the relatively strong Citizens Arrest power we all have, and notably we aren't bound by the probable cause rule police deal with under Tennessee v. Garner. Most states agree with People v. Couch, save for a few like Nevada which passed a law disallowing civilian FFR shoots. As to the AK-47, Semi-automatic AK-47's and similar military looking arms are not actually assault weapons because they don't have a full automatic (machine gun) firing option, aka Selective Fire. In semi-auto mode they are functionally no different than semi-auto hunting rifles. At close range it's very deadly in either the semi-automatic or full-automatic mode because of its large .30 caliber (deer rifle sized) bullet vs. an AR-15 or M16 which use a .223 caliber bullet which hunters mainly use for shooting vermin like coyotes, woodchucks, small wild pigs etc. OTOH - at more than 50-75 meters the AK-47's loose tolerances, which make it reliable under inclement conditions, make it relatively inaccurate compared to other arms - especially hunting arms. DocM Posted January 8, 2014 Share Posted January 8, 2014 The AK-47 in stock trim is a good "swamp gun," mainly for hunting where the ranges are short and its ability to shoot after being immersed are advantageous. There are also differences depending on where it was made - not all AK's are equal. Bulgarian is among the best. Where it fails is where the accuracy difference is enough to miss, example being hitting a whitetails heart at >150 meters. That's not an unusual shot in Michigan power/underground pipeline right of ways & farmlands. I've taken deer at 300+ meters, and antelope/deer hunters out west would have similar experiences.
