"Windows" -- Unsuitable Trademark?

For so many people who own their PC(s), the word Windows is like the Sun over their head. But some one(s) spouted: No, that word is not suitable for the name of a trademark!

Microsoft is suing Lindows.com for Trademark infringement because the Lindows name sounds similar to Windows, and they think people are going to get confused and think they are buying a Microsoft product.

A: The word "windows" is a generic term that has been used widely throughout the industry for years. Countless products and companies have used the term "windows" as part of their name. Microsoft waited 7 years before filing for a trademark and, in part because so many other software companies used the term to identify software that used on-screen windows, the Trademark Office found the term to be generic and rejected Microsoft's application on two separate occasions. In 1995, after years of trying (this is the part we can't talk about yet), Microsoft finally got its trademark despite the existence of dozens of others uses of the term at the time. Lindows.com believes the evidence will show that Microsoft has no legitimate right to a trademark for the word "windows" and that consumers are not confused between Microsoft Windows XP and LindowsOS.

I think he is saying something along the lines of 'Windows' being such a common word in the English language, that it shouldn't be trademarked, or something.

Any given word can generally be trademarked for a specific commercial use. You can't release (potentially competing) computer software and call it Windows, but you can, say, design a line of wristwatches and call them "Windows".

Ultimately, yes, trademark stuff (and if and when it's legal/appropriate) can be often confusing.

Windows is a limited trademark by U.S. law. One certainly can't release another computer OS with the same name, but MS doesn't have blanket rights to "Windows" no matter what's produced. Just can't make something that's potentially, reasonably confused with MS usage.

I'd like to remind those who yelled how confused this thread was -- this forum is called "NeoWin", which means "Neo Windows". So I don't need to explain what is "Windows".

Obviously semifamous and poind were so clear -eyed to

come to the point of this thread. That is one of the whys that NeoWin can exist and has been showing its charm. :)

Some smart-asses like MxxCon wanted to pretend know-it-all while actually lost common sense about NeoWin.

i named my dog windows... so when its pooping near the bar i yell NO BAD WINDOWS BAD DONT DO THAT NOOOOO!!!! my friends all think windows is geat though, its very loving and it tries so hard for attention

I have to agree. I can't understand anything that he says. It seems like he's running these words through a translator or something. That's totally fine, however he's starting up new threads. I can see why everyone is frustrated. And yes, English isn't his first language and no, my Chinese isn't better than his English (even though I am Chinese), but you don't see me going to Chinese forums and starting up new threads that no one can understand. It's sad because he puts people down when they can't understand him. I've seen guys get lectured for starting up nonsense threads or duplicates and they'd end up being closed. But when a guy starts up one that's totally incomprehensible, we have to be compassionate because his English isn't understandable?
