Apple and themexp??

has anyone seen this on Themexp?

Apple's Copyright - 02.13.02 @ 6:18 PM EST

Apple has contacted ThemeXP and notified us that we are in violation of Apple's copyright on OS X by hosting two themes: "EclipseOSX v4.40" and "MacOSX Aqua 3.2". As much as we enjoy long and expensive lawsuits against mega-corporations, we decided to comply with their notice of infringement and take down both of the two themes we previously hosted.

I think Apple is planning to sue God because of the shades of blue in the sky. Oh, that and Mother Nature because one of her employees (a snake apparently) used a specific piece of fruit in a public work of literature.

That sucks! As long as we already have it, you guys did the right thing the money you guys would of lost wouldnt have been worth two themes lol. Hey at least you know the site is well known even to the MAC guys.

This totally sucks. Not even microsoft sued someone when they hacked the uxtheme.dll to customize windows, but if you try and make if LOOK like something, then they bite ya in the ***. Why to go Apple, YOU SUCK!

yea but put ur feet in apples shoes, would u personally like someone coping u? to tell u the truth i agree with apple don't know why but why make windows sometrhing it will never be and just go out and buy a bloody mac.

Even for not being into Mac or Aqua themes, I think that pretty much sucks. Not that surprising though. Apple has always had a history of trying to hoard what they think of as theirs. But I have a question though. If Apple is so anal about msstyles that look like Aqua, why haven't they gone after and yanked the WindowBlind's Aqua/Mac styles yet? They come a lot more closer to looking like the real thing.

I dislike all this Mac stuff, but its pretty gay of Apple to do that. I've never heard of MS getting mad at Unix guys making skins for their respective shells. Leave it to Apple though.

Someone should show Apple the WindowsXP Silver theme and give them directions to Redmond.

Why is AquaSoft still up? WOW, I SURE AM GLAD NOBODIES TOLD APPLE ABOUT AQUASOFT.

It might be because we make no money from the site? ThemesXP does advertise, generating revenue, Apple doesn't want them making a cent using their themes...I don't know, I'm stretching here, someone help me...

I'm a little dissappointed by your attitude Timan. Especially considering your ties with Aquasoft. Hope your just having a bad evening or something.

Except that StarDock generates revenue from WindowBlinds, which as pointed out earlier, does a better job of mimicking OSX. And certainly there are plenty of WB,OB and DX themes being hosted on Wincustomize that replicate it as well. I dunno. . .maybe it has more to do with ripping actual images/icons from OSX for use in themes?

Apple has gone after Stardock for Desktop X and Windowblinds aqua themes and it's kinda odd cos until people started making msstyles aqua lookalikes you couldn't find a wb aqua theme cos stardock would pull them in fear of apple retribution. Odd how they have them now

could it be to intice people into buying wb and getting the whole experience? I dunno.

Over at AquaSoft, one of the new guys was making a VB app about 8 months ago, and not knowing any better, he wrote off to Apple asking for permission to use their Aqua style.

What happened next was one of the strangest things I've ever seen.

He recieved a letter from Apple giving him permission to use the Aqua GUI on a Windows app! They asked him not to sell his application (he had informed them it was freeware upfront) and to use all applicable trademarks and copyright notices.

Now, in the back of my mind I have always been suspicious of this 'permission' letter, although I have always sided on the side of belief for 2 reasons;

1.) The guy was in talks with Apple at the time to create a third party drive tray for the iMac. (Nothing ever came of it...)

2. Apple has never asked AQUASOFT to close down. No legal action, not a word. Which is funny, because we recieve about 1-2 emails a week from irrate Mac users that inform us we are evil and they have notified Apple of our website. 99% of these letters wish to see us burn in HELL.

I don't know. I think Apple should have shut down AquaSoft a long time ago if they were just out to kill any non Mac use of the Aqua interface. On the other hand...maybe the site is unnaturally lucky and the guy who got the letter had been a little too creative in MS Word (if you catch my meaning).

Actually, the WB skins appeared first, then everyone and their dog started making aqua skins for msstyles.

Stardock had trouble with Apple a couple years ago and had to remove the skins from one of the pages. Not sure what agreement they came up with, or what the deal was. It could be becauset those had OSX in the name, but there is a WB skin with osx in the name too, and its still on wincustomize.

i remember Mac skins ever since WB started. i really like the Mac OS8 skins and the OSX skins are the most customizable ever. i really like msstyles but if you want a skin w/the buttons truely where they should be osXP for WB is the skin to get. it looks awesome. i like my min/max/close buttons where they normally and not

i know wincustomize.com had problems w/the OSX copy skins b/c OSX had not been released yet so that pi$$ed apple off. my guess is that the styles on themexp.org had fonts and images like icons and wallpapers ripped from OSX. w/msstyles being new this probably raised their attention so they decided to put a lid on a few of the biggest offenders. it would be nice if apple gave exact reasons or themexp would post those exact reasons so when making skins people know what will get them in trouble and not do it. like the forums here there are certain guidelines that have to be followed and if you follow those rules you have a lot of leeway to do and say what you want. apple seems to be pretty cool about mimicing their style and ya know imitation is the sincerest form of flattery. :cheeky:
