Xero
Hey guys, I'm wondering a few things, is it legal for cops to search you without a warrent? or is it like the US where you need one? I'm not sure, and any other tips would be useful.
Rob2687
I think they do need a warrant. try looking here.. http://laws.justice.gc.ca/en/C-46/
Xero
I've read through it, they talk about a warrent to search but it mainly speaks upon searching a house ect. Not exactly a body.

Xero
90% I read more, they can search without one on certain situations. ie arresting or if they believe you have a weapon. And my only concern is when I'm at a party and the cops come and they try to search me (when I don't have a weapon or anything on me, maybe just some weed) I can tell them to **** off get a warrent :)

shakey
if a cop wants a warrant to search a place, it will take them around 15 minutes to get one if u tell them they need it. it happened to my friend, so dont think if they dont have one it doesnt matter, it doesnt take long for them to get one :(
Xero
Hmm, ya I know running is the first choice naturally, but like if you get swarmed by them :) your outta luck.

But where could you possibly be that you're going to get swarmed by a bunch of cops in Canada? If you don't mind me asking.
imtoomuch
Or you could just give up the weed... And don't ever do what matt74441 said. Running from the cops is a sure way to get chased down and tackled by them. Running away from the cops looks awfully suspicious.
matt74441
Well I wasn't serious :p I'd probably soil myself if cops busted a party I was at.
GrandMaster
Are you sure they need a warrant to search people in the US? afaik cops need a warrant for the following: ur backpack is closed = warrant (or a good reason) glove compartment locked = warrant trunk locked = warrant unless they have dogs barking at it or theres pounding coming from inside house = warrant keep in mind, when they ask you if you mind if they search your house/backpack etc you dont have to say no, tell them you do mind and they wont do it
-=SD=-
Better wear some running shoes, at all times, never know when cops just bust in a room to search you.

They'll just confiscate it for "personal" use.
Xero
Yea I know, it's not like I have anything to hide, I just don't like cops so I like being difficult :) As for why they would swarm me, is when they say don't run and you run :)
biorK
Depends on the situation. If it's a party where they suspects to be illegal activities, ie. drugs, weapons, hard underage drinking etc. then there's a big risk they search you. Like.. if they suspects there's illegal stuff on you they got the right to search you. And all cops have a good feeling if or if not it's a criminal or not. But if it's a party with 50+ people it's hard to search them all, they usually only stop the party.
GNRambo
house = warrant Nope, they don't need a warrant for your house if theres a Domestic Disturbance or if there is a prob in your house (ie drunks fighting) I love Cops the show

mmm
I was told that if you put your "whatever" say weed in an envelope that is sealed, stamped and addressed the police cant open it because the mail system is federal jurisdiction not provincial. So only the RCMP could open it.

You'll have better luck by being polite and respectful. "Yes sir, we'll quiet the party down sir." I've had the cops come to my house (back when I lived with my parents) and I've been at other parties where they have arrived. I only got two squad cars at my party but the biggest high school party got at least six. Well, we do what we can...
slack
During my first year of University the police showed up at our house a total of twelve times in the eight months we were there, however it was usually only one or two cars. However nearing the end of the year my room mates + I were up the street at a house party where ten cars + a van showed up, it was ridiculous, it wasn't even overly loud, it's just like they had nothing else to do so they all came to this one house to bust the place up. And this is in just Halifax, with a population of about 300,000.
