What to do?

Well about 3 months ago I ordered a set of 17" rims for my car off of ebay. They were used, so I got them a decent price.

When I was looking to buy them, the auction said they were coming from Tennessee, but after I had won the auction the person that was selling them told me that he was on a military US base in Belgium and then said that is was going to take a month for me to get them. I wasn't very happy at first, but I just let it go.

Well 3 months later, I still have yet to see the wheels. In e-mails he has told me that he took care of his end of the deal so it's not on his shoulders anymore. It is too late to file fraud with eBay. I have already filed fraud with paypal, and he knows this. So he sends me an e-mail telling me if I retract the fraud with paypal that he will pay me back $250 of the $435 I spent on the wheels. The problem with that is, it's not $435!

I have his first and last name, a phone number that was in the eBay info that I requested and that's about it.

I'm just wondering what can I do legally about this. Is it false advertisement since they were coming from a place other than what I was told they were coming from? If worse comes to worse can I take him to court? I really am starting to doubt that he ever sent the wheels cause if he did, why would he offer to pay me more than half of my money back?

I'm going to have my lawyer look into this too I think, but I was just wondering what all of you think.

:huh: You don't seem to have the best luck on the Net ! I think it would be fraud. I would take the half payment of the money, and I doubt you can do much more, cuz it will cost you lots in legal fees, prob. Good luck tho.

Trust is the last thing when it is the matter of money..... and that too on web.

I dont trust net, my simple CV is also not anywhere into my mailbox.

I keep it in my PC.

Net is not secure.

At the time of opening an account with websites they force you to accept certain terms and conditions. That thing is their main weapon. If anything goes wrong they comes out clean.

Forget it man

It will take years to solve this scam.

You can do one thing.

Dont from onwards trust net.

Only physical transaction can be trust worthy.(atleast you can fight back if anything goes wrong)

I would continue fighting it with paypal. Unless there is more to this story that you would like to share. I would not take the $250 of the $435 you gave him. Tell him if he returns the $435 you will drop it. But I would not take the $250.

What is paypal doing about this and what has been said?

As far as legal action go, it would take forever, and I hope you would not be paying anything to your lawyer, like would he do this for free, if not, don't bother, unless you want to go to small claims court, I don't know anything aobut this but I know you pay what a small fee for it? I could be wrong, I have no idea on this I just was talking with a friend and he had mentioned like $75 to do it, of course that is here, not sure about anywhere else. I am dumb with this stuff ;o
