Woman Who Claims To Find Finger In Chili Won't Sue Wendy's

SAN JOSE, Calif. -- A woman who claimed she scooped up a human finger along with her chili at a Wendy's restaurant has decided not to sue the fast-food chain.

Anna Ayala dropped her claim because it "has caused her great emotional distress and continues to be difficult emotionally," said her attorney, Jeffrey Janoff.

Ayala, 39, claimed she found the 1?-inch long fingertip on March 22 while dining at a Wendy's restaurant in San Jose. She later filed a claim with the franchise owner, Fresno-based JEM Management Corp., which her attorney had said was the first step before filing a lawsuit.

Phone calls to Ayala's house went unanswered Tuesday. Investigators searched her Las Vegas home last week as part of their investigation into how a finger ended up in the chili.

Wendy's spokesman Denny Lynch declined to comment on Ayala's decision not to sue, but said a reward hot line to receive tips will remain open. Wendy's has offered $50,000 to the first person who can provide verifiable information that identifies the origin of the finger.

"It's very important to us to find out what really happened at the restaurant," Lynch said. "We will continue to fully cooperate with the police investigation."

Wendy's maintains the finger did not enter the food chain in its ingredients. None of the employees at the San Jose store had lost any fingers, and no suppliers of Wendy's ingredients reported any hand or finger injuries, the company said.

The Santa Clara County coroner's office used a partial fingerprint to search for a match in an electronic database but came up empty. DNA testing is still being conducted on the finger.

Ack...I hate when people try to pull **** like this. The question is...where did she get the finger from? She'd be even stupider if she knew the person who used to have that finger...

Emotional distress my ass. She's freaking out because she might be prosecuted. I know I would just to freak out anybody else who tries to pull something this stupid.

It's being reported that an aunt of hers recently died. I think a DNA test will be done to determine if the finger is her aunts. Or maybe it has already been done.

Btw... this woman has brought suits againt companys before. I think about six other crazy ones. So she is a whack job to begin with.

If she planted it, it must have cost Wendy's a bunch, think of how their Chilli sales will have fallen in the past few weeks. They could sue her for damages.

I worked at a Wendy's a while ago and the only way a finger would get into the chili would either be some moron back there who cut their finger off on purpose (since you don't use anything sharp to make it) or its planted. I guess it could be packed in somehow, but I find that highly unlikely. You'd see it while it was cooking for a few hours.

If she did plant it, she can kiss her ass goodbye. Dave will rise from the grave to take her down.

she obviously planted it if she is backing down now that Wendy's isn't bending over to take this...

I think Wendy's should sue her for tarnishing there reputation...I am sure they have lost at least Some business because of this dumbass's ploy.

You're right. She's a dumb ho, but she's a dumb ho with no money which is why she did this in the first place. She's gonna back out before Wendy's does what I think they should do...prosecute her to the fullest extent of the law, just for being that stupid.

Very right my friend, but poor or not, this is hardly the way to make a buck. ...My god, at least see it through if you're going to try this...backing out just screams "You caught me, I made this up" ...emotionally distraught" ...pssh, you couldn't have been that surprised when you bit into the finger you just placed in the chilli you moron :rolleyes: :whistle:

How do you go about getting a human finger to start with, I think if someone took mine I'd probably notice. That is if I'm alive.
