Lafave Rejects Plea Deal, Date Set For Trial

TAMPA - A prosecutor and defense attorney stood in court on Monday to say they could not come to a pre-trial deal in the case of Debra Lafave, the Greco Middle School teacher accused of having sex with her 14-year-old student.

``Negotiations have broken off and now it's going to trial,'' defense attorney John Fitzgibbons said after the hearing. ``It's time to tee it up.''

Judge Wayne Timmerman set a trial date for Dec. 5. The trial is expected to last about two weeks.

If convicted, Lafave, 24, could face up to 15 years in prison on each of two charges of lewd and lascivious battery.

Fitzgibbons said the prosecution's plea deal involved ``significant prison time'' and he found that unacceptable.

``To place Debbie into a Florida state women's penitentiary, to place an attractive young woman in that kind of hell hole, is like putting a piece of raw meat in with the lions,'' Fitzgibbons said.

Assistant State Attorney Mike Sinacore said his office worked with the family of the victim to determine what would and what would not be offered in the plea deal.

Neither side would provide specifics on what the offer included.

According to court records, witnesses told investigators that Lafave's relationship with her teenage student grew flirtatious as the 2003-2004 school year wound down. That summer, they kept in contact.

Police say Lafave had sex with the student in her Riverview townhouse and again in the portable classroom where she taught English.

During a trip to Ocala, the teen's aunt saw the pair and called his mother. He leveled with his mother and she called police. Lafave was arrested on June 21, 2004, after several phone calls between her and the teen were monitored.

She faces similar charges in Ocala.

damn, i sure as hell would have done my pretty 24 years teacher if i was 14. lucky kid. but the teacher is most likely gonna suffer for giving in due to the boys mother.

not like 14 year old kid is going to get affected by her in a bad way. my friend have lost virginity to an older woman which came on a trip with his family. he was 14 too i belive. actually it made him a much better person, gave him confidence. he just seemed happy for 2 month straight.

edit: there was picture? hell yeah - lucky kid! i honestly dont think its a big deal. and unless his family is getting a cash settlement i dont see why would they press charges. sheesh - they can ruin this girls life.

probably uptight parents.

I've just finished watching the news report on FoxNews.com and can you believe he actually admitted the affair? Why would he do that and ruin it? I would've been like... :huh: sorry don't know what you're talking about.

i'm sure all these comments would be different if it was a 24 year old man with a 14 year old girl. mebbe not but probably wouldn't be as many "hit it" ccomments at least.

Yeah, I think this is a bunch of crap. It's not like she raped him or anything. His parents could of done something other than call the police. I just think it's funny how the U.S.A makes a big deal over the age. In other countries and time periods, people were getting married around his age.

oh booo hooo, dont do the crime if you can do the time, what if it was some other crime? I agree with FudgeMonkey also what if it was a male teacher and a female student, Im sure you guys will be more "put basatards like him away" or the famous "kill people like him", silly how people here forget morals because of an so called "attractive" woman. Think about the parents who raise the boy, what if it was your kid, would you still be ok with that? Im sure your wife wont be ok with it
