She 13 - going through her teens and is very venerable. The guy took advantage of that and her parent shouldn't have granted permission to marry.

On a counter note to people who say: well people a 100 years ago use to get married when they were ten. We dont live in the 1800s, society conditions have changed as have social rules. in the 1800s women didnt have rights, does that mean we can now surpress womens rights?

Kansas really needs to change that law, although that's probably not going to happen anytime soon, that's what you get for letting a bunch of rednecks govern themselves. For all you saying that the government should but out, governments are in place to provide a sense of order. The laws relating to statutory rape make sense, a 22 year old man should under no circumstances be allowed to have sex with a 13 year old girl, that's paedophilia and oh-so wrong. The prosecutor is doing his job, he has every right to file these charges and so he should. As for the parents, some people just don't deserve to live... They are effectively condoning paedophilia, it's disgusting. Only in America.

I don't think the guy should be charged. They ARE leagally married, and the parents of the girl agree, and it doesn't seem like she was forced to marry him, so i don't see the problem. Its their buissness, not ours, and not the governments.

By implying everyone in Kansas is a redneck and completely disregarding that other people have different customs is just wrong. Governments are in a place to protect society established rights it does not provide the sense -- that's the job of the citizens in a democratic society. Just because you can't take plurality doesn't mean it's wrong.

A 22 year old and a 13 year old is not paedophilia because most children aren't 13, hell the 22 year old is probably just a 22 year old boy. Who are you to define what are the accepted mores of a society considering that you don't even live in Kansas. I'm not condoning it, but the age CATEGORY is pretty much negligent and I probably couldn't care as long as it's a mutual agreement (plus the parents agreed).

Hell I was engaged in High School when I was 16... She was 18.

Here are the issues as I see it...

22 year old (21 at the time probably) had sex with a 13 year old. That is Stat rape. He should have been prosecuted then. However that didn't happen, and all parties involved, including parents agreed to a marriage. At that point, since she is a minor, but the parents agreed (legal guardianship) the law should have been satisfied. The girl wasn't coerced into the marriage (I think, no proof to the contrary). So, age has now gone out the window. The gov't should not have any say into their personal lives. Every possible person in the family has consented knowing all the info.

I completely agree that it is... icky for someone that age to be with someone that young... ok, too bad, it happened. It is over.

Oh yeah, and the gov't should be applauding the guy for at least sticking with the girl and marrying her instead of dumping her like he could have.

If I'm understanding correctly, the evidence suggests that they had sex prior to marriage. So to everybody on this thread: the fact that they are married is irrelevant (well, it's definitely unusual, and arguably wrong, but it is irrelevant to the charges).

In other words, the title of the thread should be: "Man charged for having sex with a 13 year-old girl"

It's not impossible to get married while in high school or just after high school. I knew a young couple back in high school who had known each other for about 8 years already (since they were both 9-10) who had agreed to marry shortly after their high school graduation. The guy was 18 and the girl was 17 on the day of the wedding. Both sets of parents wholeheartedly approved in this case, and the couple is still happily married now 4 years later.

Yes, I know that the two cases are rather different, but don't assume that a high school student cannot get married. It is indeed possible. ;)

it's legal with parental consent.... i live in nebraska. That kinda thing is kinda rare now. My grandmother was married at 15 to my grandpa who was 22. They had their first child after he came back from liberating Europe.

i thought it was illegal to marry anybody under 18....not for moral issues so much as for the fact that you can't sign a legal document until you're 18 (same reason you cant get a credit card until you're 18)...unless maybe the girl had parental consent.....which is even more f'ed up....

Sex laws need to be changed over in america, theyve just looked at changing ours, they may change it from 16 (only for female, male can be any age) to 12, under the condition that the age gap is no more than 2 years. Over here, if you have sex with any females that are under the age of 16, even under her consent, you're screwed. Not even marrying will get you off anything.

Technically he's not a pedophile since adolescents are no longer biologically children. Calling it pedophilia is probably a product of a Victorian-era mentality that's evolved to a point where we're conditioned to be turned off by what the gov't determines to be the legal age of adulthood. However, every person enters puberty at different times and develops at different rates. The gov't can't write laws respecting that because it would leave way too much room for case-by-case interpretation, resulting in precedents that would be used to argue one 14 year old be allowed to do what this or that 12 year old was allowed to do, and ultimately clog up the courts.

So a standard age is set, and suddenly everybody is grossed out when anyone does anything younger.

Meanwhile boys are wanking at 10 and god knows what girls talk about in their underground community (restrooms). Kids are sexual beings, as much as adults, they're just very inexperienced, and very quick to make bad decisions in that area of their lives.

If anything, that girl's husband, if he is a truly caring person who honestly does love the girl, could provide a very strong, stabilizing force in that girl's mental development of her sexuality. However, seeing as he got her pregnant, he's probably just a horny college guy...

The Diagnostic and Statistical Manual of Mental Disorders 4th edition, Text Revision, American Psychiatric Association includes a Diagnostic criteria for 302.2 Pedophilia:

A. Over a period of at least 6 months, recurrent, intense sexually arousing fantasies, sexual urges, or behaviors involving sexual activity with a prepubescent child or children (generally age 13 years or younger).

B. The person has acted on these urges, or the sexual urges or fantasies cause marked distress or interpersonal difficulty.

C. The person is at least age 16 years and at least 5 years older than the child or children in Criterion A.

He IS a pedophile, like it or not, this sick man needs to be locked up and the key thrown away.

Er, yeah, the definition says "generally", which means they aren't fully committing to 13 years old being the line. Which is smart of them, since boys and girls enter puberty years apart (boys being the ones who wouldn't start till 13ish--and that would be a late bloomer).

The genders are not equal in development at all. Unfortunately, political correctness would probably put concerned women up in arms if they heard a man wasn't 'sick' if he was into 13 year old girls.

P.S., fantastic job ignoring all of the other issues I brought up in my previous post. It's good to know you're skilled at focusing entirely on pedophilia being sick. You probably had an interesting childhood.

What make these laws even more hypocritical is that American advertisers are sexualizing youth in ads.

Human society will have to re-examine their definitions of what is a child as more people are maturing physically at an earlier age. Unfortunately human society, especially the US, are coddling their children into the young adult stage of development.

I'm not saying this is right, but I think it is too late now that they are married and the only reason why I do think it's wrong is because of the status of 13 year olds in our "current" society.

What makes these types of things wrong are a differential in power and emotional maturity. In our modern society, 13 year olds are "treated" as children but you have to realize that it was not always the case.

Nature may force us to revise our definitions some day.

I agree completely. If this man were a minor, I'd see no problem, but this is a near decade age difference, this is a full grown adult and knows exactly what he is doing. Like you said: there are 16 year olds being locked up for the same crime! It's such a shame... :no:
